On October 14, 2026, the Superior Court entered two orders in the pending quarry litigation, Tussahaw Reserves, LLC, et al. v. Butts County, Georgia, ruling in favor of Tussahaw. One order declares the property’s existing A-R zoning unconstitutional and directs the County to rezone the property to a constitutional zoning within 60 days. The other reverses the denial of Tussahaw’s use permit application and directs its approval following the rezoning. Butts County respects the Court and the judicial process but respectfully disagrees with these rulings. Accordingly, the County intends to appeal both orders. Because this remains active litigation, the County will present its arguments by way of counsel and its court filings and will have no further comment at this time.
