FAQ FRIDAY: If I'm planning to sell my property, can I get the form for that from your office?
No, by State statute, we aren't allowed to furnish forms or fill out the form in any way. They are legal documents with specific wording based on different circumstances - Quit-Claim Deeds, Warranty Deeds, Trustee's Deeds, Beneficiary Deeds, etc.
When brought to our office for recording, they are already completed, signed & notarized. We will check it for State requirements, such as formatting, margins, font size, date, legal description, etc.

Just a reminder that due to changes by State law, our recording fees & marriage licenses will increase by $2 beginning at 8am on Friday, August 28, 2026. For documents sent by mail, these fee changes will take place at that time, REGARDLESS OF POSTMARK, so for the next couple of weeks, you may want to deliver in person if at all possible or include the additional $2 fee in case it doesn't arrive until August 28th.
For recording documents, the first page will be $26 & remain $3 each for additional pages. For recording surveys/plats, the various sizes will increase $2 (prices vary by size).
Marriage licenses will increase from $60 to $62.

FAQ Friday: When deeding a property to someone else, does the person receiving the property have to sign?

Some Missouri deed forms include a place for the Grantee (person receiving the property) to sign. However, this is only required if the real estate is located in St. Louis City. No other Missouri county or city requires the Grantee to sign - only the Grantor (sellers/transferors).
The Grantor signatures have to be notarized. If your form included an area for Grantees to sign & they did, the deed can still be recorded IF those signatures are also notarized.

Thank you to everyone who voted for me on Tuesday, August 4th. It means so much to me that even though I was running unopposed, so many voters still marked my name to show their support. I have not & will not take this for granted.
My 3rd term as Benton County MO Recorder of Deeds will begin January 2027. The protection of the records & serving the public will continue to be my top priorities in the office.

FAQ: How can I find out if my property was ever surveyed?
Plats & surveys are recorded in our office. However, while subdivision & town plats must be recorded, not all surveys are required to be recorded under Missouri law.
If your property is in a subdivision - for instance, Cole Turkey Acres, Mack's Grand River Development, Lakeview Heights OR in city limits such as Warsaw, Lincoln, or Cole Camp, we will have the original plat of that in our office. The original plat is the drawing signed & recorded by the developer showing the size & location of each lot in that subdivision or town. Those are indexed by the name of the subdivision or city, so can be found rather quickly.
Surveys are the measurements of a particular piece of property (subdivision or section-township-range) done by a surveyor at the request of an individual, bank, realtor, etc. These are a bit trickier to find since our records back to 1839 were primarily indexed by name. Since this would be the name of the owner at the time of the survey, the current owner doesn't always have that information. There are a few different ways we can help - first of all, I can usually tell by the legal description whether it (or a surrounding property) was surveyed, as it will contain directions such as "N 36 degrees W". IF you have any info at all about a survey being done, knowing the approximate year &/or owner's name helps A LOT. I can also check with other sources - such as the Missouri Department of Ag - to see if they're aware of a survey. Even then, as I mentioned earlier not all surveys have to be recorded.
So, if this is something you're inquiring about, contact us with all the info you have at [email protected]. Please keep in mind that it may take a couple of days to find the info. Copies are $1 per page, but most plats/surveys are only 1 or 2 pages.

FAQ Friday: How old are the records in your office?
The Recorder's Office records date back to 1839, when Benton County was established - primarily land records & marriage licenses. All of these have been digitized (with the exception of a few index books to be completed soon). Though this was done to make it easier to print a record, it was also done to protect the condition of the older books. Previous Recorders had the oldest books (1800's) recovered & laminated which helped tremendously. Since we can now look at the documents on the computer screen, there is also less handling of the other volumes - meaning they will survive for decades to come.
The original books are held in our office vault, which dates back to 1887. The books are public records, so you're welcome to stop in & see the vault any time.
