Labor Day marks the beginning of jury trial season for our office. This time is challenging, demanding, and fulfilling for us.

CONVICTION:

James Gallagher is a serial ra**st that has victimized at least three separate victims. Today, Mr. Gallagher has been convicted of two counts of First Degree R**e, one count of Attempted R**e, and one count of Kidnapping.

He has received a judgment to serve two life imprisonments without the possibility of parole, plus an additional 40-years in prison. Mr. Gallagher will never be able to victimize anyone ever again.

Our office held a press conference with law enforcement authorities regarding the criminal case associated with the Sand Springs explosion that left two people dead and caused damage to numerous businesses. Following this incident, more charges were brought against Ryan Bassham for a subsequent incident. All individuals charged with a crime are innocent until proven guilty. See the recap of DA Kunzweiler’s comments below:

Recap of initial investigation:
-On August 27th at approximately 1:15am the Sand Springs Police Department was dispatched to an explosion located at 411 South Lincoln Ave in Sand Springs later identified as "Solos Extracts".
-Two victims died as a result of the explosion and numerous businesses were damaged.
-The Oklahoma State Bureau of Investigations took command of the investigation and identified Ryan Bassham as the owner of Solos Extracts.
-This investigation alleges that Mr. Bassham is responsible for this explosion because it was a result of Manufacturing Controlled Dangerous Substances.
-This investigation resulted in Mr. Bassham being charged with two counts of First-Degree Murder under Oklahoma Statue 21, section 701.7 (B).

Initial Bond:
-A warrant for Mr. Bassham's arrest was issued and he turned himself into the David L. Moss Criminal Justice center for two counts of First-degree murder on August 30th.
-Mr. Bassham bonded out of jail with a bond of $2 million.

Creek County Investigation:
-On August 31st, the Oklahoma Bureau of Narcotics executed a search warrant at a property owned by Mr. Bassham in Creek County.
-This investigation resulted in charges for Aggravated Trafficking of Ma*****na, Aggravated Manufacturing of Ma*****na, and the Use of a Firearm while committing a felony, based on evidence collected at the scene.
-OBN agents seized approximately 1,330 pounds of processed ma*****na product, approximately 140 pounds of ma*****na batter, two fi****ms, and other evidence consistent with manufacturing ma*****na products outside the regulated ma*****na market.

Current Bond:
-Mr. Bassham is now in custody at the Creek County Jail, and is being held without bond.
-My office is taking action to revoke his bond in Tulsa County as well.

Conclusion:
-My office looks forward to partnering with the relevant law enforcement agencies to examine the facts and evidence of this case in prosecution.
-This situation unfortunately serves as a reminder that Oklahoma has a ma*****na “black market” problem that threatens the safety of Oklahomans.
-This problem must be adequately addressed by the Oklahoma Legislature, and other state leaders.

Our office was proud to host the 9th annual rally against fentanyl with several partners and members of the community.

Fentanyl poisoning has brought an unimaginable grief to our community. We will continue to find truth and seek justice for the victims of these drug distribution and trafficking crimes, and we will charge offenders with murder whenever we can. A clear message needs to be sent, don’t peddle dangerous drugs in Tulsa County if you don’t want to go to prison.

We are cracking down on DUI crimes thanks to recent Oklahoma legislation that amends the law to trigger a misdemeanor DUI changing to a felony Aggravated DUI with greater consequences.
