Pima County Attorney Statement on Jessica Corrales-Duarte Theft Case
TUCSON, Ariz.—Pima County Attorney Laura Conover has released the following statement regarding questions surrounding a pending Laken Riley case currently in our office.
“The public record makes clear that the case at issue involves the theft of over $5,000 of a high volume of brand-name perfumes and makeup over several days, caught on camera, coupled with a taped confession. Although that amount is higher than most of our organized retail theft cases, generally speaking, a person with no criminal history would and should be afforded an opportunity to enter a diversion program whereby they work steadily to repay what is owed and learn how to never end up involved in the criminal justice system again.
Here, unfortunately, ICE has taken custody of the individual under the framework set up in the Laken Riley Act. Just as I predicted when I strenuously campaigned against passing this Act, the attempt to deport the individual under an allegation alone (not a conviction) deprives the individual of due process and deprives the State of its work of making victims whole again. I will continue to advocate for the repeal of the Laken Riley Act where I can.
In the meantime, the record makes clear that we have nonetheless persevered to offer a plea agreement that should mitigate harsh immigration consequences, secure accountability, and make whole the victim. The choice to accept the offer is between her and her lawyers.”

TUCSON, Ariz.—La Fiscal del Condado de Pima, Laura Conover, ha emitido el siguiente comunicado en relación a las preguntas que han surgido respecto a un caso pendiente de Laken Riley que se encuentra actualmente en nuestra oficina.
“El registro público deja en claro que el caso en cuestión se relaciona con el hurto de un alto volumen de perfumes y cosméticos de marca por más de $5,000 durante varios días, registrados en las cámaras, junto con una confesión grabada. Aunque el monto es superior a la mayoría de nuestros casos de hurtos organizados a tiendas, en términos generales, a una persona sin antecedentes penales se le otorgaría y debería otorgar la oportunidad de ingresar a un programa de derivación en donde trabajan de manera constante para reembolsar lo que deben y aprenden a no involucrarse nunca más en el sistema de justicia penal.
Desafortunadamente, aquí ICE ha tomado la custodia del individuo bajo el marco establecido en la Ley de Laken Riley. Tal como predije cuando hice una intensa campaña en contra de la aprobación de esta ley, el intento de deportar al individuo bajo solamente una acusación (no una condena), priva a la persona del debido proceso y priva al Estado de su trabajo de reparar los daños de las víctimas. Seguiré abogando por la derogación de la Ley Laken Riley en donde pueda.
En el intertanto, el registro deja en claro que, no obstante, hemos perseverado en ofrecer un acuerdo de culpabilidad que debería atenuar las duras consecuencias de inmigración, asegurar la responsabilización y reparar los daños de la víctima. La decisión de aceptar la oferta es cosa de ella y sus abogados.”
