nd activities of member organizations and the services and charities they support; to sponsor meetings and workshops for charitable organizations on how to apply for support from member organizations; to conduct research and provide education about the funding of nonprofit organizations; to educate the public about the funding needs and services of organizations that provide services to local communities and to generally engage in activities designed to strengthen the nonprofit sector.

Our efforts in working with the AG’s office and the legislature on HB 33, the AG has filed two rules with JCARR this morning to increase threshold of net profits for charitable organizations from proceeds of sale of bingo and instant bingo! Rule 109:1-4-21 increases the current $250,000 threshold to $350,000. A public hearing for the rule will be held on Tuesday, June 13, 2023 at 10:30 AM.

As you are aware, over the last two years ACCO has pursued both statutory and administrative code changes that would allow for an organization with a D-4 liquor permit to sell alcohol for on-premises consumption while it is conducting traditional bingo games. Last month, ACCO submitted testimony in support of proposed changes to the authorizing administrative rule at the Joint Committee on Rule Review (JCARR) and today, Dec. 22, the Liquor Control Commission filed the rule (4301:1-1-53) with JCARR as “Final” for an effective date of Jan. 1, 2023.

In essence, on New Year’s day, patrons of a Veteran or Fraternal club that possess a D-4 permit will now be able to purchase alcohol and carry it across the threshold into the social hall where Type I bingo (traditional bingo with paper) is being played.
