Congratulations to the Class of 2026!

On behalf of the District Attorney’s Office, congratulations to each of our graduates. Graduation is more than receiving a diploma — it is the beginning of a new chapter filled with opportunity, responsibility, and purpose.

Heading into college, careers, military service, trade schools, or wherever life may lead you, remember that your future is built by the choices you make today. On Monday, District Judge Jeffery Shannon granted a motion for pretrial detention filed by the Eighth Judicial District Attorney’s Office, ordering that Andrew M. Duran be held pending trial following his arrest after a police pursuit and collision with a Taos Police vehicle on Quesnel Street on April 21.

Duran is charged with Aggravated DWI (Fourth Offense), Aggravated Fleeing of a Law Enforcement Officer Resulting in Injury, Aggravated Assault on a Peace Officer with Intent to Commit a Felony, Aggravated Battery Against a Peace Officer with a Deadly Weapon, Criminal Damage to Property over $1,000, and Driving on a License Revoked for DWI.

In granting the motion, Judge Shannon cited the serious nature of the offenses, the strength of the evidence, and Duran’s extensive criminal history. In his written order, Judge Shannon encouraged defense counsel to obtain a substance abuse assessment for Duran and indicated that pretrial detention could be reconsidered if a verified treatment plan adequately addressing his needs and public safety concerns were presented.

I commend the Taos Police Department for their efforts to intercept Duran’s vehicle and prevent a potentially dangerous situation on a busy pedestrian street.

This incident placed both the public and responding officers at significant risk. When someone repeatedly drives impaired, disregards court-ordered conditions, and escalates their behavior by fleeing law enforcement and colliding with a police vehicle, swift action is necessary. Our office sought pretrial detention to protect the community and ensure accountability as this case proceeds.

A dangerous and exploitative individual is off the streets of our community. Fentanyl is poisoning and killing our family members, friends, and neighbors. These types of offenders endanger everyone to whom they deal these deadly drugs, and my office will continue taking all steps possible to pursue accountability.

Following a guilty verdict by a Raton jury, Eighth Judicial District Judge Steven Romero has sentenced Justin Vosicky‑McCoy to nine years in prison for trafficking a controlled substance and four years of probation for possession of various other controlled substances.

The charges stem from an incident on April 8, 2024, when Raton Police responded to a call and conducted a thorough investigation. The investigation led to Justin Vosicky-McCoy’s house. Officers located over five hundred fentanyl pills and other controlled substances. In October 2025, a jury found Justin Vosicky McCoy guilty of Trafficking Fentanyl and possession of co***ne, oxycodone, and Alprazolam.

At sentencing, Judge Romero described fentanyl trafficking as “a crime of exploitation” and imposed a nine-year prison sentence for trafficking.
