Since the discovery of an abandoned infant in Stafford County earlier this week, the fire and rescue department has received several inquiries regarding the Safe Haven Law and the role of fire and rescue in it. The purpose of this post is informational only, and not to generate speculation regarding the circumstances of an abandoned or surrendered infant.

Under the Safe Haven Law in Virginia, a parent can surrender an unharmed infant who is 30 days-old or younger to a staff member at a hospital that provides 24-hour care, emergency services agency or in a newborn safety device at one of those locations. In these circumstances, the law can provide certain protections from certain criminal or civil proceedings. In Stafford County, this means all fire and rescue stations and Stafford Hospital Center are Safe Haven locations. It is important to note, as defined by the law, the parent must surrender the infant to a staff member at one of these locations, not just leave the infant there. Stafford County Fire and Rescue currently does not have newborn safety devices at its stations.

Upon receiving a surrendered infant at a fire or rescue station, providers will assume care of the infant and notify the proper authorities to include the Stafford County Sheriff's Office. The ultimate goal in a difficult situation such as a surrendered infant is to ensure the health and safety of both the infant and the mother of the child.
