We are extremely concerned for this season and ask our amazing public to please join us in doing all we can to prevent disaster.
The patriotic display of fireworks is something that is near and dear to us all, but there are laws in place for safety reasons. It takes one spark for tragedy to fall upon us.
Idaho Code 39-2609 explains the general prohibition provisions used to address fireworks by law enforcement. Violations are listed as an infraction punishable by a fine of $100.
Other statutes in that chapter give further definitions of what is considered to be legal when it comes to the use, sell, short term storage, and public display of fireworks.
With the burn ban in place and the language contained therein, violations of that ban fall under Bingham County Ordinance 5-4-8 and are considered a misdemeanor, to include the non-authorized use of aerial fireworks.
