A default judgement was ordered in the above-noted case for Michael McKiearnan on March 19th, 2026.
A Civil Complaint was issued by the Jamestown Tribe Prosecuting Attorney Tim Rybka on 05/02/24 and filed with Jamestown Tribal Court Clerk. A Civil Summons for 1st Appearance was prepared by the Clerk on 05/02/24. On 05/03/24, the complaint/summons was sent to the address noted above by 1st Class and Certified Mail, for Civil 1st Appearance on June 20th, 2024. Certified mailing was returned undelivered, unable to forward on 05/14/24.
On 06/20/24, the case was called. Tribe notes a resolution has been reached between both the Tribe and both defendants (Maggie McCoy JAM-CIV- 04/24-24). Deft signed waiver and waives reading, McKieranan is pleading guilty to possession. Court accepts and goes through arraignment and plea.
A $2000 fine, $1000 suspended. $1000 fine imposed. Deft is to pay $50 per month, he has 24 months to pay (06/20/2026); and will be on probation for 2 years. Court inquires if the Defendant understands the terms of the agreement – Deft: yes, Your Honor.
The case was reviewed by Order of Show Cause on 03/19/26, no appearance to note, mailings returned undeliverable. Tribe states NO payments have been made to date; Clerk has been unable to reach either Defendant through US mail. Tribe requested and was granted a default judgment in the amount of $2000, based on the negotiated settlement of 06/20/24 wherein Mr. McKiearnan would pay the $2000.
To reiterate, the Court Clerk has had NO communication with Mr. McKiearnan, and NO payments have been made.
HENCE, a $2000 Default Judgment is due and payable to Jamestown Tribal Court as of March 19, 2026.

On 06/20/24, the case was called. Tribe notes a resolution has been reached between both the Tribe and both defendants (Michael McKiearnan JAM-CIV- 04/24-23). Ms. McCoy has “no money, Mr. McKiearnan does” and he will pay $1000 in 24 months. Ms. McCoy will have a suspended $2000 fine, if McKiearnan does not honor the resolution and does not pay the $1000, Ms. McCoy will have a $2000 default judgment. No payments were received by the Clerk of Jamestown Tribal Court.
The case was reviewed by Order of Show Cause on 03/19/26, no appearance to note. Tribe notes NO payments have been made to date by codefendant; Clerk has been unable to reach either party through US mail. Tribe requested and was granted a default judgment in the amount of $2000, based on the negotiated settlement of 06/20/24 wherein Mr. McKiearnan would pay the $2000 and if no payments were received, Ms. McCoy’s deferred $2000 fine would be ordered.
HENCE, a $2000 Default Judgment is due and payable to Jamestown Tribal Court as of March 19, 2026.
