The Human Trafficking Survivors Relief Act was recent passed by the US House of Representatives. This act would establish an affirmative defense for trafficking victims, meaning that survivors will legally have the opportunity to defend against only those charges that came directly as a result of being a trafficking victim and provides relief for survivors who have already been convicted on charges as a result of their trafficking victimization through vacatur, expungement and sentencing mitigation.
Victims and survivors of trafficking will often be forced or coerced into committing crimes by their trafficker. This bill gives those victims and survivors an avenue to have their criminal records removed so that they don't have that record hanging over them as they try to move forward.
