Today, CalPrivacy’s Enforcement Division issued a new advisory highlighting data brokers who provide incorrect information in their annual registration with California’s Data Broker Registry. Under the Delete Act, businesses that operated as a data broker in the prior year must register with CalPrivacy. As the advisory cautions, failure to provide correct information is a violation of the law, and data brokers can face fines for each day incorrect information appears.

The Data Broker Registry gives Californians important visibility into what types of information data brokers collect and who they share it with. Californians should be able to rely on accurate information to make informed decisions about exercising their privacy rights. We are thrilled to share that 2 additional CalPrivacy supported bills have officially passed the California Legislature:

✅ AB 883 (Lowenthal) will ensure elected officials and judges are informed about their right to have their information deleted from data brokers and require data brokers to respond to deletion requests for all Californians within 30 days.

✅ AB 1542 (Ward) will prohibit the sale and sharing of sensitive personal information.

This is in addition to the CalPrivacy-sponsored bill, SB 923, which passed the legislature last week. We are grateful to the legislature for their work on these important bills. All now head to the Governor for his consideration.

The CPPA Board has ordered Virginia-based data broker, SalesIntel Research, Inc., to pay a $36,400 fine for failing to register with the agency's Data Broker Registry by the 2025 deadline. This decision reminds businesses to examine whether they qualify as data brokers and ensure they are properly registered as required by law. “This ongoing enforcement activity shows that CalPrivacy takes seriously the failure to register by the deadline,” said Tom Kemp, CalPrivacy’s executive director. “As a reminder, exposure to potential enforcement action is increasing now that data brokers have started processing requests through DROP.”

This latest action, part of a sustained effort by the Data Broker Strike Force, underscores the Enforcement Division’s commitment to rigorously defend Californians’ privacy rights and uphold the law.
