☣️ Think your condition is from toxic exposure, but it's not on the presumptive list? You can still file.
"Not on the list" doesn't mean "not connected." It means you have to show the link yourself.
📋 First, check every list. Your condition may already be on one:
Agent Orange: type 2 diabetes, heart disease, high blood pressure, Parkinson's, prostate cancer
Burn pits and Gulf War: asthma diagnosed after service, COPD, chronic sinusitis, head, neck and lung cancers
Gulf War illness: chronic fatigue syndrome, fibromyalgia, IBS, unexplained symptoms
Camp Lejeune: kidney, liver and bladder cancer, leukemia, Parkinson's
Radiation: most leukemias, thyroid, breast and lung cancer, multiple myeloma
(These are examples. Check VA's full, current lists.)
✅ Not on any list? You'll need 3 things:
1️⃣ A current diagnosis
2️⃣ Proof of your exposure: where, when, your job and what you were exposed to (DD-214, orders, unit history, buddy statements)
3️⃣ A medical opinion saying it's "at least as likely as not" caused by that exposure, explained with medical research
📝 The steps:
File an Intent to File (VA Form 21-0966) to protect your date
Gather your exposure proof and get a nexus letter
File VA Form 21-526EZ and answer the toxic exposure questions
Under the PACT Act, if you show a toxic exposure and a diagnosis, VA generally has to give you an exam and medical opinion (38 U.S.C. § 1168)
Denied? File a Supplemental Claim with new evidence, ask for a Higher-Level Review or go to the Board
💡 Other routes that may fit: secondary to a condition you're already service connected for (38 CFR § 3.310), Gulf War undiagnosed illness (§ 3.317) and radiation dose review (§ 3.311).
⚖️ If the evidence is evenly balanced, the tie goes to you (38 U.S.C. § 5107(b)).
