Two weeks later, we gathered in court again. I didn’t think much of it. It should be a simple case. They cited me. I complied and fixed the problem. I took my grandson with me. I thought it’s a simple case, and baby generally behaves well in a short period of time.
But things suddenly got complicated. First I saw one of neighbors walked in. We chatted a little. I didn’t think much. Then as the time spproaching, another showed up, and another. Total, four of my neighbor showed up. I realized they are here for my case. All of us waited, and waited. It’s way pass the scheduled time. I realized we are all waiting for the white attorney general who is my next door neighbor and who will be the plaintiff. I got angry, so angry that I have to get up and start pacing in the waiting room. Pacing is my meditative method to calm me down.
Finally, I saw him walking towards the court with a couple of men. He was all dressed up with shiny shoes.
Soon, the court was open for us.
As usual, the judge let the plaintiff speak first. The inspector stated the case, at the end he wanted to add a few more citations to the judge. The judge started making some statements. He didn’t turn to me to ask if I have anything to say. I knew if I don’t speak now, I may not have a chance to speak. I said: “Wait a minute, I am the defendant. Please allow me to defend myself.” I started to request permission to tape record the court. That’s something during my search for the case I thought by doing this they may take me seriously even though I have no idea whether it makes any difference. At lease it set up the atmosphere as if I was the lawyer defending myself.
The first question I asked was the department set up a 311 line to encourage citizens to report any violations. But is there any mechanism or procedures to determine if the report is valid or not. A flurry of discussion followed. My point was if it’s like my neighbor reporting me for more than once, do you ever wonder if it’s a case of bullying or vengeance?
My second question was: Why did I get two second notice? One on May 30th, 2018 and one of June 15th, 2018. It seems this person originally sent the notice on June 15h, and then changed his mind to send it on May 30th. As a result I got the second and final notice on the same day on June 15th, 2018. I know the proper procedure is to wait for 5 to 30 days before issuing the next notification. It seems the inspector originally wanted to follow the 30 day rule, then all of sudden changed his mind and wanted to push the case faster. Why?
Of course all kinds of issues and explanations were explained to me. And the judge was talking to me like educating a grade school student again. I asked the judge to please allow me to raise all the questions and keep them in the record.
I then asked the question that when I was in the department checking my records, I found my address of my other property in my file. Why the department didn’t send me a copy of the notice to my address where I live?
None of my questions were answered definitively. Lots of frivolous arguments were fired. They didn’t know I have a severe fear for public speaking. I tried my best to keep my composure. Finally, I said to the judge: Your honor, please look at the people sitting behind me. I turned around and raised my left arm to draw a big curve. “Do you see what do they all have in common?” I asked. After a pause, I said: they are all whites. I said, I know it is difficult to fight the city on these code violations. However, if I can prove racial discrimination, I may have a chance to win.
The director of the PLI department feverishly argues that their practices are all fair without discrimination and proceeded to explain their way of collecting data. At that point I was pretty tired of her frivolous arguments. I simply cut her short and said, I am not talking about all the cases you have processed; I am only talking about my case.
Judge Butler made a lengthy comment, at the end he said something like: when things are going your way, just take the win and run. I pretty much finished my questions. I know this court will not deal with the issues I raised. As I said before I just wanted to make a record of my defense.
So I was abated with my first citation. But what about the three or four citations they wanted to add in court? I called the inspector next day. He was very respectful this time. We discussed all the issues, and he said he will not cite me on those anymore. After that, I finally realized that I have won totally.
However, I was too happy too soon. Months later, I received another notice for some of the citations they wanted to add. The story of my nightmare has not ended yet.
