I've been doing a lot of research and reflection in the wake of the Mayor's veto.
Section 1155 of the Norwood Zoning Code is about Planned Unit Developments. It's been interesting to dive into the code to help me address my own questions as well as the rhetoric that has been circulating.
My key takeaway from the code related to this discussion is that the Planning Commission AND Council have a responsibility to require and approve zoning standards. The Planning Commission has done their work. They requested the P.U.D. on 7 Nov. 2024 and council approved their request. We have followed the process.
The Planning Commission is comprised of the Mayor and his appointees. Two of his employees are part of the process; the Safety Service Director and the Building Commissioner. This stage of the PUD process is largely the Mayor's purview and responsibility.
The zoning code clearly states that Council also has its purview and responsibility to regulate and approve the PUD. In the image I have underlined just a few of the examples where the code states that both the Planning Commission AND Council have their roles. In some cases the responsibility is solely upon Council.
It is my duty as the representative of the people of Ward 3 to listen to and respect their concerns. The feedback I have received about this matter is overwhelmingly against the current plans. I feel obliged to continue to object the current plans.
Secondly, according to our code the Planning Commission and Council both have their duties in this process. While the Mayor is within his legal right to veto Council's decision, I believe the decision negates Council's role and thus subverts the PUD process.
I will be pursuing Council's right to override the Mayor's veto in this decision.
