Update from AACS, our national association:

We're excited to share some good news with you. At the Thursday night awards program last week we collected an offering for Ukraine refugee relief. The offering collected was $10,050.82. That's more than double any previous offering collected at Nationals! We're grateful for every student and coach and parent who participated in the offering. A check has already been delivered to the International Board of Jewish Missions and they are already in the process of sending the funds to four IBJM missionaries who are housing, feeding, and otherwise assisting internally displaced persons in the country of Ukraine.

Be Informed!
California Opens the Door to Infanticide

Police could be sued for arresting baby killers
By Greg Burt

SACRAMENTO, CA -- Gov. Gavin Newson's abortion council dropped a legislative bombshell. The group of policy makers intend not only to codify the killing of unborn children throughout all nine months of pregnancy but to decriminalize killing newborns days or weeks after birth.

New language added to AB 2223 last week revealed the disturbing intent. The proposed legislation would shield a mother from civil and criminal charges for any “actions or omissions” related to her pregnancy, “including miscarriage, stillbirth, or abortion, or perinatal death.” Although definitions of "perinatal death" vary, all of them include the demise of newborns seven days or more after birth.

The bill from Assemblywoman Buffy Wicks (D-Berkeley) also protects anyone who “aids or assists a pregnant person in exercising” these rights. It also allows a woman to sue any police department or legal authority which arrests or charges her for hurting or killing her child under provisions of the bill.

“For years, pro-life advocates have argued there is no moral difference between ending a child’s life days before birth or days after birth. California’s pro-abortion legislators now seemingly agree,” said Jonathan Keller, President of California Family Council.

“A political culture that justifies killing millions of children in the womb is now declaring open season on unwanted newborns. Every Californian must oppose this heinous bill.”

Newsom formed the “Future of Abortion Council” last year in an effort to turn California into a “sanctuary state” for the procedure. Organizers listed AB 2223 as part of their legislation package implementing a 45-point plan to “expand and protect access” to abortion in California.

A few weeks ago, Maryland introduced a bill that “decriminalizes neglecting newborns to death” using the same “perinatal death” language, though the bill hearing was canceled. In 2019, Virginia Gov. Ralph Northam was widely condemned for a radio interview asserting doctors could decide to allow children to die after birth “if that’s what the mother and the family desired.”

The first stop for AB 2223 is the Assembly Judiciary Committee, though legislators have yet to announce a hearing date.

The following legal experts, all based in California, asserted that AB 2223 would essentially legalize infanticide:

AB 2223 is not only a pro-abortion bill – it removes all civil and criminal penalties for killing babies born alive under any circumstances. The bill expressly authorizes any person to facilitate late-term abortions and infanticide without legal repercussions. Life Legal condemns the use of euphemisms like “personal reproductive decisions” and ‘reproductive justice’ to justify and encourage the killing of babies in and outside the womb. - Attorney and Chief Executive Officer Alexandra Snyder of the Life Legal Defense Foundation

California lawmakers have crossed a red line by seeking to legitimize the killing of hours-old and even week-old infants. This is not about expanding abortion rights; this is a degree of evil that The overwhelming majority of Americans, regardless of how they identify politically, cannot stomach. We will be working to defeat this insane and diabolical bill. - Attorney Matthew McReynolds with the Pacific Justice Institute

AB 2223 seeks to legalize the killing of babies in California after birth. Depending on how the term ‘perinatal’ is interpreted by the courts, this bill legalizes the infanticide of children several weeks after their birth and possibly as late as their first birthday. If this barbaric bill is enacted, there will be no criminal or civil liability for the mother or those who assist her with killing her baby post-birth. - Attorney and President of the National Center for Law and Policy Dean Broyles

Under the guise of “reproductive health,” this bill seeks to decriminalize killing babies not only in the womb, but also even after the baby is born. This is the most extreme, anti-life bill in California’s history. It legalizes infanticide, plain and simple. - Attorney Nada Higuera with Tyler & Bursch, LLP

In California under AB 2223, former Philadelphia abortionist Kermit Gosnell, who murdered three infants born alive after botched abortions, could not be prosecuted. And incredibly, someone like Gosnell who helped a California mother kill her newborn after birth will actually have a cause of action to sue police for investigating the matter if AB 2223 becomes law. -Attorney Susan Arnall, Esq., Director of Outreach, Right to Life League

SAVECALIFORNIA.COM NEWS RELEASE

September 29, 2016 -- For Immediate Release

Gov. Jerry Brown orders 'men,' 'women,' 'boys,' 'girls' restroom signs be torn down
Thomasson: "If familiar 'men' and 'women' restroom signs are torn down, people will ask 'who did this?'"

September 29, 2016 / Sacramento, California -- A leading family values organization in California is very concerned that Governor Jerry Brown has attacked the moral sensibilities of small business owners, home business owners, and church schools by signing AB 1732 to tear down "men," "women," "boys," and "girls" restroom door signs, and replace them with pro-tr*******al "all gender" signs.

"AB 1732 tears down 'men' and 'women' signs and replace them with pro-transgender 'all gender' signs at single-occupancy restrooms," said Randy Thomasson, president of SaveCalifornia.com, which promotes moral virtues for the common good. "There's no exemption for home businesses or religious entities. This is a vast overreach that tramples average people's constitutional rights. And ironically, this bill incentivizes small businesses to go from two restrooms to one restroom."

"Governor Brown obviously didn't realize the ramifications of this radical state takeover of the private sector's restroom policies," Thomasson said. "AB 1732 is so far reaching, it will place new mandates on all 'places of public accommodation' -- religious schools and colleges, home businesses, day care centers, senior centers, and everybody else who wants to keep restrooms safely separate between men and women, boys and girls. And it obviously paves the way for mixing together men and women, boys and girls, in multi-person public restrooms in the future."

"This government mandate coldly tramples Californians' moral consciences and private property rights, and confuses children to think there are numerous 'genders' -- when there are only two biological sexes, male and female," Thomasson said. "AB 1732 brashly defies science, which says you're male if you've inherited a Y chromosome from your father and you're female if you haven't (see "23 and Me" facts). By promoting the unhealthy tr*******al agenda, the State is putting more people at risk, since transgender behavior results in the highest HIV/AIDS transmission rate in the nation, according to the CDC."

SaveCalifornia.com analysis of AB 1732 "single-user restrooms"
What 2 key sentences mean + definition/application problems

(a) All single-user toilet facilities in any business establishment, place of public accommodation, or state or local government agency shall be identified as all-gender toilet facilities by signage that complies with Title 24 of the California Code of Regulations, and designated for use by no more than one occupant at a time or for family or assisted use.

This means:

1. All the "men," "women," "boys," and "girls" signs and symbols currently on single-occupancy restrooms at applicable venues must be removed.

2. "All gender" signs and symbols (could be transgender symbols) must be posted instead.

3. Small businesses that wish to save time and money can go from having two restrooms (men and women) to only one restroom ("all gender").

4. Even home businesses come under the "any business establishment" phrase.

5. "Place of public accommodation" is undefined in the bill and by default means private entities of several types. Federal law, under the Americans with Disabilities Act, says the only places of public accommodation are private entities. Under AB 1732, which private entities are included and which are excluded? Small businesses, home businesses, religious businesses, schools, church schools, churches -- where in the bill does it say who is included and who is exempt? Besides the lack of definition of "public accommodation," there is no religious exemption in AB 1732.

(c) For the purposes of this section, "single-user toilet facility" means a toilet facility with no more than one water closet and one urinal with a locking mechanism controlled by the user.

This could mean:

1. For businesses that must have restrooms -- such as food service or gas stations -- under this definition, must they now pay to install men's urinals in current women's restrooms? Why or why not, since "single-user toilet facility" is officially defined as "a toilet facility with no more than one water closet and one urinal."

2. For home businesses, must they now pay to install a men's urinal in addition to paying for and posting an "all gender" restroom sign? Again, AB 1732 defines "single-user toilet facility" as "a toilet facility with no more than one water closet and one urinal."

"AB 1732 will result in unforeseen, negative consequences," Thomasson said. "What woman wants a man poking his head in the restroom door that somehow didn't shut or lock? How many girls or women want to use a urine-stained toilet seat? What conflicts will erupt among strangers from mixing or eliminating gender differences at restrooms? What lawsuits will occur? If familiar 'men' and 'women' restroom signs are torn down, people will ask 'who did this?'"

"It's sad that business community leaders didn't fight this bad bill like they did in other states," Thomasson added. "And it's deeply disappointing that some pro-family leaders said this anti-family bill was somehow acceptable and 'makes a lot of sense.' Their dereliction of duty makes no sense."

"Business owners, home business owners, and church schools should protect their moral consciences and the children their influence by ignoring this unconstitutional law," Thomasson concluded. "Religious freedom is being crushed by this and other tyrannical laws, but without local enforcement of AB 1732, people who believe in basic family values have every reason to protect their cherished religious freedom and property rights from this unscientific, anti-child, social-engineering agenda."
