A great day for our clients!

Mediation can be very effective tool in alternate dispute resolution, especially with reasonable and competent adjusters.

This fairly straightforward claim was muddied through built a third party audit that didnt read thee assignment. This relatively small scale claim still required as much or more leg work and head pounding than most large commercial claims we’ve run into.

Special thanks to Chris Courville for the solid work on a relatively minor claim. Early documentation, clean writing and determination were all helpful.

Special Trustee Appointed to Assist McClenny, Moseley and Associates’ Louisiana Storm Clients

Louisiana Supreme Court Chief Justice John L. Weimer appointed Edward J. Walters, Jr. of Walters, Papillion, Thomas, Cullens, LLC, as a special trustee over the storm-related suits filed by McClenny, Moseley and Associates, PPLC (MMA) in Louisiana courts.

Commissioner issued fines totaling $2 million to MMA, founding partners James McClenny and John Moseley, and Louisiana managing partner William Huye III for engaging in unfair trade practices and insurance fraud involving at least 850 Louisiana homeowners and policyholders.

While this bill appears to try and speed up the process of claims payouts it simultaneously prevents the homeowners and business owners from any litigation recourse by changing getting rid of the way attorneys fees and bad faith are handled.

While speeding up the insurance claims handling process sounds great, it is inherently what leads to so many bad claims. There are not enough well trained adjusters on any insurance carriers roster to handle the full scope after a catastrophe. With them speeding up the process, adjusters will be pumped into cattle calls and hired from burger king windows just to get the claims closed out according to a rushed deadline. AND if they mess your claim up, your recourse is now so limited that they don't care.

We have completed a small unbiased case study comparing Commonly used methods of roof measurements by adjusters including Hand measuring, Google earth measuring, Ridgetop, Eagleview and Hover. We have compared accuracy, cost, time from order to delivery/time to measure and sketch, as well as availability of the files to be exported. These results will vary based on factors such as roof complexity, available imaging data and obstructions, the adjuster's experience level and skill in software. Take it as you will.
