In 2017, Alabama made an important decision to end judicial override in capital cases. Our state recognized that when a jury has carefully heard the evidence and recommended a sentence of life without parole, that judgment should stand. It was a meaningful step toward strengthening trust in our justice system and honoring the role juries are meant to play under the Constitution.

Yet there are still individuals on death row today who were sentenced under that earlier system and their cases remain tied to an outdated practice. So, we must ask ourselves this simple, important question: If we now believe that system was unconstitutional, how should we respond to those who were affected by it?

The Bible teaches us in Matthew 5:7, “Blessed are the merciful, for they shall receive mercy.”

On Sunday, Alabama Gov. Kay Ivey's Instagram account featured photos of Ivey as a little girl, saying this is the little girl from Camden who grew up to be Alabama's governor. Perhaps unexpectedly, the comment section of that post was flooded by hundreds of people demanding clemency for Alabama inmate Charles Lee "Sonny" Burton, who was scheduled to be put to death this week.

"On Tuesday morning, Gov. Ivey did the right thing," writes cartoonist JD Crowe. "She commuted Sonny Burton’s death sentence."

"Thanks for doing the right thing, Guvnah," Crowe continues. "Whether you admit it or not, I think you made ‘Just a girl from small-town Camden’ proud."

On the eve of the anniversary of Bloody Sunday in Selma, we remember people beaten for demanding justice on the Edmund Pettus Bridge.

Yet today, Mr. Myers could spend the rest of his life in prison after being forced, as a Black man, to accept legal representation from a member of the Ku Klux Klan. The struggle for justice didn’t end in 1965.

Rocky Myers, a Black man, was sentenced to death after being represented at trial by John Mays, a court-appointed attorney long affiliated with the Ku Klux Klan.

"I am deeply disappointed in how this case has slipped through the cracks, and am concerned about Alabama’s system of justice if it allows Mr. Burton’s ex*****on. Justice should not be rigid or blind to context. It should be thoughtful. It should be humane. It should allow for mercy when mercy is warranted."

I once helped sentence a man to die. That truth will always stay with me. But today, I am asking my state to choose a different path.
