“Stop CPS From Legally Kidnapping Children” is the association of 12,000+ parents who support the efforts of our foundations programs.
Our number one priority is to keep children out of the failing foster care system and with their families whenever safe to do so!
FPF desires to defend and preserve the individual rights and liberties guaranteed to children and parents in this country by the laws of the United States as it relates Child Protection Services and Foster Care. Nonpartisan, the FPF works through litigation, advocacy, publicity efforts, and education and it has over 12,000 members. The FPF provides legal assistance in Child Protection Services and Foster Care cases when it considers civil liberties to be at risk. Legal support from the FPF can take the form of direct legal representation or preparation of amicus curiae briefs expressing legal arguments when another law firm is already providing representation. Furthermore, FPF desires to ensure that no person is denied their right to equal justice because of poverty by providing pro bono legal services from local trial courts all the way to the United States Supreme Court for all children.
Currently most states do not provide attorneys to children; In the states that do, Minnesota being one of them, the child must be over 10 years old. The child would get a state-provided public defender, but this attorney has no reason to advocate for the constitutional rights of the child and reunification of the child with their parents, because the longer the case stays open, the more money they get paid. FPF seeks to fill this gap.
What is utterly unbelievable, and the most astonishing thing that we have learned by far, is a thief who steals a pack of chewing gum is legally entitled to evidentiary hearings, a jury trial, and has more rights than a child being placed in a foster home and removed from their parents forever. This is OUTRAGEOUS!
PHASE 1 Minnesota (September 2018-forward)
Knowing the enormous financial burden that lay ahead, the founder, Dwight Mitchell, set up a non-profit, tax exempt organization to gather donations from people of good will and foundational grants to support the defense of children and parents, which had to proceed pro bono, due to the incredible legal costs that the families were unable to afford. Thus, the Family Preservation Foundation was born. Over the course of the last 12 months, 3,080 man-hours and $300,000 of private funding has gone into establishing this effort, opening offices, and making this dream a reality. Although just starting, FPF has rescued 12 children from Child Protection Services and Foster Care thus far, and returned them to their parents.
Our short term goal is to hire full-time attorneys to grow our Minneapolis, Minnesota and Piscataway, New Jersey offices, while adding offices in other counties. Our long term goal consists of a multi-state Federal litigation strategy. After filing our Federal action in Minnesota, we will be going state to state, starting with the worst ones, reviewing state statues, and seeking federal injunctions for the preservation of families due to unconstitutional laws or non-compliance with federal mandates for funding.
We will work to get these children and parents to get them the PTSD psychological care they will need after these horrific experiences that the government currently doesn’t provide for. This is a large and expensive undertaking from a legal services perspective.
Safety planning organization, if required would be privatized, and a key focus area of our organization and Termination of Parental Rights (TPR) would be a last resort and TPR trials would be conducted before a jury of pear parents.
This includes but is not limited to the over turning of court orders where parents have had their parental rights terminated due to fabricated evidence, misleading court information, and/or the withholding of exculpatory evidence. We also seek jury trials for all termination of parental rights proceedings.
The SECONDARY goal of this program is to share with others what works against the fight with CPS and there illegal practices, while we work on legislative change.
There are various horror stories about CPS. CPS corruption throughout the United States has been documented by the media, family rights groups as well as private citizens.
Through my research and Federal Civil Suit against the government I'll show you how to fight CPS. I also want others to share what they learned and their experience with other members. Please only share experiences that have worked for you in your fight against CPS.
This doesn’t mean that children don’t need to be protected, and that all Social Workers are bad. But the research has shown, that children have been taken from families and put in foster care for bogus reports, unfounded allegations, outright lies, and fabricated evidence.
