Public Notice: Burn Ban has been lifted

Effective April 24, 2026 at 4 p.m., Frederick County will be lifting the Burn Ban that was put in place on April 16, 2026.

We would like to thank everybody for your cooperation during the burn ban. We will continue to monitor the weather patterns and ground fuel moisture, working with our state and federal partners. Please continue to monitor the county's website and social media pages for further.

The Frederick County Fire Marshal's office would like to remind everyone that fire safety starts with you. While conducting any burning operation please take safety first and obey all burning regulations.

February 15th – April 30th Open Burning is allowed between 4:00pm and 12:00am
The Virginia Department of Forestry (DOF) mandates and enforces the “4:00pm burning law” effective February 15th through April 30th of each year during which open burning may only take place between the hours of 4:00pm and 12:00 midnight.

Open burning is allowed under the following conditions:

•When not otherwise prohibited as outlined in the above Open Burning Regulations section.
•All such open burning must be reported to the Frederick County Emergency Communications Center at (540) 665-5645 prior to ignition and when the fire is extinguished.
•Open burning may be no closer than 500 ft. from a brush/wood line.
•Open burning may be no closer than 500 ft. from an occupied dwelling, excluding your own, without prior written permission from the occupant(s) of the neighboring occupied dwellings.
•Fires shall be attended at all times by competent persons 18 years of age or older. A minimum of one portable fire extinguisher complying with Section 906 with a minimum 4-A rating or other approved on-site fire extinguishing equipment, such as dirt, sand, water barrel, garden hose or water truck, shall be available for immediate utilization.
•If at any time the fire is not attended it must be fully extinguished.
•Legally set open air fires are subject to all local regulations.

🚫 Public Notice: Burn Ban in Effect ❗❗️❗️

Due to the increased risk for wildfires due to the current extreme atmospheric and drought conditions, Frederick County will be under an open air burn ban effective
Thursday, April 16th, 2026, until further notice.

No person shall kindle or maintain or authorize to be kindled or maintain any open burning during this time. This prohibition includes all bonfires, ceremonial fires, camping fires, barrel fires, etc. This regulation does not include barbecue grills, smokers, or any device that emits smoke through a chimney or stack.

This action is being instituted in accordance with Chapter 45 Article II section 45-10 E of the Frederick County code on the recommendation of Frederick County Fire Rescue System Fire Marshal and Fire Chief by the County Administrator.
The Frederick County Fire and Rescue System - Office of the Fire Marshal will continue to monitor these adverse conditions daily and make recommendations to the County Administrator and the Board of Supervisors on when to lift or amend the burn ban.

Violations and Penalty – Violations of the open burning regulations may result in being charged with and convicted of a Class 1 Misdemeanor, which carries a penalty of a fine up to $2,500.00 and up to a year in jail. Further, if convicted, the responsible party may be held liable for all damages and the costs of firefighting operations.

Safety tips during this dry period to reduce the chances of fire include:
•Do not discard ci******es by throwing them down, use ashtrays or water to make sure they are out before disposing. Discarded ci******es do cause fires and can be disastrous in times of drought and high fire risk.
•When pulling off the side of the road, stay off dry grass areas. Park vehicles so that the exhaust does not contact dry grass, leaves or weeds.
•During this time, do not burn household trash in barrels.
•If you cook outdoors, never leave barbeque grills or smokers unattended. Place your grill or smoker on concrete or your driveway away from combustible materials. If using charcoal or wood, make sure that the fire has been extinguished by soaking it with a garden hose before disposing of the coals.
•Move anything that will burn far away from structures, items like firewood, compost piles, brush piles, etc.
