Background:

On Monday, Feb. 2nd, House Bill 1333 passed the Indiana House by a narrow 56-43 vote and is now in the Senate and assigned to the Utilities Committee.

Authored by State Rep. Kendell Culp, HB 1333 is a dangerous preemption bill that, in its current form, bypasses local zoning control by deeming virtually any development, including data centers and other intensive and polluting development, proposed on many types of agricultural land (IV-VIII), as a permissible use. This both undermines local authority to block certain projects and eliminates the right to a public process.

HB 1333 also sets a bad precedent for rezoning proposals, particularly in rural communities like Jasper County. The same day HB 1333 passed the House, Jasper County Commissioners approved a massive rezoning request for a data center (linked to Amazon) and a 2,600-megawatt combined-cycle gas plant at the NIPSCO Schahfer Generating Station in Wheatfield, alongside a peaker gas plant. The Commissioners cited legislation, including HB 1333, as tying their hands. The Schahfer plant is already under federal emergency orders to continue burning coal beyond its retirement date. At the same time, residents face an ongoing coal ash crisis that is contaminating the local aquifer.
