In Pennsylvania child custody disputes, judges do not pick favorites. Under PA law (23 Pa.C.S. § 5328), courts must evaluate specific Statutory Custody Factors to determine the “Best Interests of the Child”!

Top factors judges weigh heavily:

1. Child Safety & Protection: Evidence of abuse or risk of harm.
2. Parental Duties: Who historically handles daily routines, doctor appointments, and schoolwork?
3. Need for Stability: Maintaining continuity in school, community, and family life.
4. Level of Cooperation: Which parent encourages ongoing contact with the co-parent (when safe)?

Building your custody case around these statutory factors, not emotional arguments, wins in court!

Thinking about reducing work hours or underreporting cash income to minimize child support? PA Domestic Relations offices scrutinize earning capacity closely! 💡

In Pennsylvania, child support is calculated using Monthly Net Income—or Earning Capacity:

• Voluntary Unemployment/Underemployment: If you leave a job to work part-time without valid cause, the court can “impute” income based on your qualifications and work history.
• Self-Employed / Cash Income: Courts examine tax returns, bank deposits, and personal expense statements to determine true net income.

Accurate financial reporting keeps you out of contempt court.

Pennsylvania updated its statewide Child Support Guidelines under Pa. R.C.P. 1910.16-3 to reflect changing economic conditions.

Key updates affecting support orders:

· Basic Support Adjustment: Support schedule amounts increased across most income levels to reflect higher costs of living.
· Income Cap Expansion: The guidelines chart net income cap expanded significantly for high-earning households.
· Expanded Medical Costs: Orthodontic, psychiatric, and psychological care are explicitly addressed under unreimbursed medical guidelines.

Crucial Note: Existing support orders DO NOT change automatically! You must file a Petition to Modify to adjust your payments.

Need to review your support order under current rules? Call Jones & Associates, Law P.C. at (610) 874-1900.

Having a Children and Youth Services (CYS) caseworker show up at your home is one of the scariest moments a parent can experience. But panicking or reacting aggressively will only hurt your case!

What to do if CYS arrives:

1. Stay Calm & Polite: Escalating tension gives the agency leverage to claim you are uncooperative or volatile.
2. Ask for Identification & Reasons: Request the caseworker’s name, supervisor, and the general nature of the allegations.
3. You Have the Right to Consult an Attorney: You do NOT have to sign voluntary safety plans or allow full home inspections without understanding the legal consequences.

Protect your parental rights from day one.
