e maintains a comprehensive Diversion Program which primarily seeks to make victims whole, to hold first time offenders accountable for their actions, and to assist such offenders in identifying the underlying causes of the behavior that brought them into the Criminal Justice System. The Diversion Program has a great track record of preventing recidivism through education, treatment, and assistance. Keeping low-level first time offenders from re-offending by early and thorough intervention is key to an effective strategy to combat crime. As the Chief Law Enforcement Official in McPherson County, the County Attorney exercises authority within the Executive Branch of Government and represents the people of the State of Kansas, specifically the citizens of McPherson County, in the prosecution of adult and juvenile violators of State law, proceedings in the Care and Treatment of incapacitated persons, proceedings protecting Children in Need of Care, enforcement of the Kansas Consumer Protection Act, and appearances on behalf of the State of Kansas in the Kansas Appellate Courts regarding criminal appeals. In 2015, the McPherson County Attorney's Office filed hundreds of criminal cases and more than 1800 traffic cases in McPherson County District Court. The McPherson County Attorney's Office also provides assistance and services to victims and witnesses. Prescription Drug Take-Back Day

On Saturday, October 29, 2022, Prescription Drug Take Back Day, from 10:00 am to 2:00 pm, the McPherson KS Police Department and Mcpherson County KS Sheriff's Office will be accepting prescription drugs for disposal at 1177 W. Woodside Street in McPherson. Please note, we cannot accept liquids or needles for disposal.

Jeremy Spotted Elk, 35, of McPherson, was found guilty after entering pleas in multiple cases.
Judge Jason Lane found Spotted Elk guilty of criminal threat, aggravated failure to appear, and nine counts of stalking after Spotted Elk entered pleas.
The cases were investigated by the McPherson Police Department, with the assistance of the McPherson Sheriff’s Office. Sentencing has been scheduled for December 9, 2022.

Eddie Eaves, 39, McPherson, was sentenced on August 25, 2022 to serve 140 months in prison for Sexual Exploitation of a Child Under 18. The case was investigated by the McPherson Police Department and the Pennsylvania State Police.
The sentence was given by Judge John Klenda. Eaves will be subject to lifetime registration as a sexual offender.

Rudy Lee Martinez, 41, McPherson was sentenced on September 7, 2022 to serve a total of 696 months (58 years) in prison. Martinez was convicted by a jury in McPherson County District Court in June 2022 of Aggravated Kidnapping, Aggravated Burglary, two counts of Aggravated Domestic
Battery, Domestic Battery, and Intimidation of a Victim. The case was investigated by the McPherson Police Department.
The sentence was given by Judge John Klenda. Kansas is a truth-in-sentencing state, so Martinez will be required to serve at least 49 years before becoming eligible for postrelease supervision (parole). Martinez will be subject to lifetime registration as a violent offender.

Timothy Kittle, 34, McPherson, was found guilty of Aggravated Indecent Liberties with a Child and Aggravated Criminal So**my on September 15, 2022 by a jury in McPherson County District Court. The case was investigated by the McPherson Police Department. Judge John Klenda accepted the verdict. Sentencing has been scheduled for December 8, 2022.

Keeter Wayne Galusha, 48, was sentenced on August 2, 2022 to serve 84 months in prison for Attempted Aggravated Indecent Liberties. Galusha will also be subject to lifetime postrelease supervision (parole) and lifetime registration as a sexual offender. The crime occurred between November 1, 2004 and February 2, 2005 and was investigated by the Moundridge Police Department and the McPherson County Sheriff’s Office.

The sentence was given by Judge John Klenda in McPherson County District Court. Galusha entered his plea in May 2022.

Sierra Lois Machnicki, 31, Bennington, was sentenced on July 5, 2022 to serve 49 months in prison for possession of methamphetamine with intent to distribute, felony theft, and burglary of a vehicle. This stems from multiple incidents: one on October 3, 2020 in which the McPherson Police Department investigated, and one on October 7, 2020 in which McPherson Police Department, Kansas Highway Patrol, and McPherson County Sheriff’s Office investigated.
The sentence was given by Judge John Klenda in McPherson County District Court. Macknicki was sentenced to the standard sentences according to the Kansas Sentencing Guidelines.
Kansas is a truth-in-sentencing state, so Macknicki will be required to serve at least 41 months before becoming eligible for postrelease supervision (parole).

Micah Robert Allen Dennett, 36, McPherson, was sentenced on June 13, 2022 to serve 57 months in prison for possession of methamphetamine and battery against a corrections officer. This stems from multiple incidents: one on April 12, 2021, in which the Moundridge Police Department and the McPherson County Sheriff’s Office investigated, and one on December 22, 2021, in which the McPherson County Sheriff’s Office investigated. Dennett was also ordered to serve an additional 70 months in prison for violating probation he was granted in March of 2018. In total, Dennett was ordered to serve 127 months in prison.
The sentence was given by Judge Jason Lane in McPherson County District Court.

Rudy Lee Martinez, 41, McPherson, was found guilty of Aggravated Kidnapping, Aggravated Burglary, two counts of Aggravated Domestic Battery, Domestic Battery, and Intimidation of a Victim on June 23, 2022 by a jury in McPherson County District Court.

The charges stem from an incident on May 5, 2021 that was investigated by the McPherson Police Department. Judge John Klenda accepted the verdict.

Sentencing has been scheduled for September 7.

Julie Ann Hunter, 44, formerly of Lehigh, was sentenced on June 10, 2022 to a total of 95 months in prison for two counts of Involuntary Manslaughter- DUI. The charges stem from a deadly crash on November 22, 2019 which was investigated by the McPherson County Sheriff's Office and Kansas Highway Patrol.
The sentence was given by Judge John Klenda in McPherson County District Court. Hunter was sentenced to the aggravated sentences according to the Kansas Sentencing Guidelines. She entered her pleas on April 14, 2022.
Kansas is a truth-in-sentencing state, so Hunter will be required to serve at least 80 months before becoming eligible for postrelease supervision (parole).

03/21/2022

Joel Matteson, 39, of McPherson, was found guilty after entering pleas to multiple cases relating to four incidents on different dates.

Judge John Klenda found Matteson guilty of possession of methamphetamine stemming from a traffic stop that occurred on August 19, 2019. Matteson was also found guilty of possession of methamphetamine with intent to distribute, which stemmed from an incident on December 7, 2019. Additionally, the Judge found Matteson guilty of possession of methamphetamine from another traffic stop on December 11, 2019. Finally, Matteson was found guilty of aggravated escape from custody when he left custody on May 6, 2021. Matteson will be required to register as a drug offender.

The cases were investigated by both the McPherson County Sheriff’s Office and the McPherson Police Department. Sentencing has been scheduled for May 12, 2022.
