FLEMING COUNTY SENTENCING UPDATE:

In February 2025, the Fleming County Sheriff’s office received a call from a distraught tipster about Timothy McCord, a registered s*x offender. The sheriff’s office responded and coordinated with the Kentucky State Police- Post 8- and Trooper Marvin Morris took over the investigation.

Following a lengthy investigation, and extensive digital forensics, with continual support and input from our office, Mr. McCord was prosecuted and finally sentenced in May 2026 to a 10 year term for a single count of in**st. McCord was captured in incriminating video with an adult victim. The victim was spared having to testify as a result of the plea and signed off on our resolution.

Mr. McCord will have to complete the s*x offender treatment program prior to being paroled and is expected to serve an additional four years. He will be a lifetime registered s*x offender.

FLEMING COUNTY SENTENCING UPDATE

On May 15, Aiden Sayer was sentenced to 15 years in prison for s*xual conduct with a minor relating to a 12-year-old victim.

The investigation was conducted by Sheriff Tim Smith, with assistance from the Kentucky State Police and law enforcement agencies in Mississippi. The case began after Sheriff Smith received a report alleging s*xual abuse involving the defendant and a juvenile victim.

As part of the investigation, Sheriff Smith obtained and executed multiple search warrants and conducted a forensic review of Snapchat accounts and other social media evidence to determine whether additional victims may have existed.

Sayer will be required to complete the S*x Offender Treatment Program while incarcerated and will be required to register as a lifetime s*x offender upon release.

The family of the victim was consulted prior to the resolution of this case.

FLEMING COUNTY SENTENCING UPDATE

A Maysville woman who says she was just “having fun” after fleeing law enforcement was captured by the Fleming county Sheriff’s office last year. She found out her sentence in March and it was 15 years.

Nicole Bainter received 5 years each on 3 counts of Wanton Endangerment after attempting to elude multiple law enforcement agencies. She was ultimately stopped by Deputy Dustin Cooper of the Fleming County Sheriff’s office.

Commonwealth Attorney Johnathan Gay said: “running from the police is not only unsafe, it’s also stupid. It turns a bad day into a bad decade! Ultimately, our officers will catch you and we will prosecute you, and you will receive much more time than if you had just accepted the consequences. We are grateful to Fleming Deputy Cooper for ultimately stopping this defendant and appreciative of all the agencies that engaged in this pursuit leading up to this.”

Fleming County Sheriff Tim Smith said “Deputy Dustin Cooper did an outstanding job bringing this pursuit to a safe end under a very dangerous situation. I’m thankful this incident ended without any innocent civilians being hurt. When someone chooses to flee from law enforcement, they are putting a lot of people at risk just to avoid accountability. I’m proud of Deputy Cooper and all the agencies involved for the work they did that day.”

Mason & Bracken County Sentencing Update:

Timothy Woodruff recently received a combined 6 year sentence for fleeing & evading in Bracken County and Trafficking in Methamphetamine in Mason County. His arrest followed a period where Woodruff attempted to elude law enforcement for an extended period of time. Mason Sheriff’s Office Chief Deputy Colten Linville and Bracken County Sheriff Bobby Boody cooperated to bring Woodruff to justice.

FLEMING CIRCUIT COURT SENTENCING UPDATE:

Eddie Joe Wallace recently pled guilty to Trafficking in a Controlled Substance, 1st Degree - Methamphetamine. He will receive 10 years. Because he was on parole, the Commonwealth further recommended an additional 2 years, bringing his total sentence to 12 years. The Fleming County Sheriff’s office worked this case with substantial support from Ky State Police- Trooper Tyler Smith. Sheriff Tim Smith was the arresting and lead investigating officer.

Final sentencing is set for 5/15/26.

FLEMING CIRCUIT COURT SENTENCING UPDATE:

On July 13, 2024, Deputy Dustin Cooper responded to a call for service at the residence of Billy Hall involving a report of a possible intruder. No intruder was located and it was determined that Hall was having mental delusions following a use of methamphetamine some days prior that led up to the event.

Fleming County EMS assisted on scene and transported Hall to the hospital for evaluation. Upon arrival, Hall exited the ambulance and attempted to enter the emergency room. As Deputy Cooper approached, Hall turned and cut Deputy Cooper on the arm with a knife.

Despite his injury, Deputy Cooper was able to quickly gain control of Hall with the assistance of EMS personnel and hospital staff. He subdued Mr. Hall and took him into custody. Deputy Cooper immediately self applied a tourniquet and received medical treatment before being transported to the University of Kentucky Hospital, where he was treated and released.

On April 17th, following a lengthy investigation, court proceedings, and contested mental health assessments and evaluations, Hall was sentenced on amended charges of wanton endangerment and was sentenced to 9 years. His sentence was probated after Mr. Hall spent nearly 2 years in custody. He will will be required to serve more than 7 years of prison time should he violate his probation.

While no outcome can undo the events of that day, this conviction provides a measure of justice through the court system. Deputy Cooper’s actions in a dangerous situation reflect the professionalism and dedication our deputies bring to this job every day.

We are thankful for his recovery and for the support shown by our community and our emergency service partners.

Bracken Circuit Court Sentencing Update:

A defendant who attempted to elude law enforcement officers by fleeing on a four-wheeler down railroad tracks in Augusta was recently sentenced in Bracken County.

Following a guilty plea, Steven Kabler was sentenced to 5 years in October 2025 for Fleeing & Evading Law Enforcement and Wanton Endangerment.

Mr. Kabler was captured by Augusta Police Chief Ken Fuller and his case was prosecuted by Assistant Commonwealth’s Attorney Michael Clarke.

His sentence has been ordered to run consecutive to a previous 2 year sentence for possession of methamphetamine. The incident where Mr. Kabler attempted to elude law enforcement followed his leaving addiction treatment without authorization - a violation of his probation.

Fleming Circuit Court Sentencing Update

A high speed chase in Fleming County results in capture and an arrest by Sheriff Smith and a 10 year sentence for the criminal.

Following a guilty plea, Isaac Spears was sentenced to 10 years in March 2026 for Fleeing & Evading Law Enforcement, 1st Degree.

Mr. Spears’ case was handled by Fleming County Sheriff Tim Smith with assistance from the KY State Police- Post 8.

Mr. Spears’ sentence has been ordered to run consecutive to any other state sentences and due to the nature of his offense he will serve at least 50% of his sentence on this case before he is eligible for parole (5 years).

Mason Circuit Court Sentencing Update:

Following a guilty plea to 3 charges- Wanton Endangerment, DUI 3rd offense, and Official Misconduct- in February, 2026, Terry Gray received a five year sentence in Mason Circuit Court on March 19, 2026. Pursuant to his plea agreement, the sentence was diverted for a period of 5 years and his release will be supervised by Kentucky Probation & Parole. He served more than 5 months in jail and was ordered to report to a 6 month drug and alcohol addiction treatment program.

Mr. Gray’s case was investigated by Mason County Sheriff Ryan Swolsky and Deputy Jonathan Wagner.

In January 2026, Torrence Garner began serving an 8 year sentence for a guilty plea to one count of Trafficking Methamphetamine. The case originated as a traffic stop conducted by the Fleming County Sheriff’s department. The FSO investigation that followed yielded evidence of drug trafficking.
