The Prosecuting Attorney of Berkeley County prosecutes all violations of state law, both felonies and misdemeanors, in state Circuit and Magistrate courts. The duties of the Prosecuting Attorney include representing petitioners on cases of child abuse, neglect and mental hygiene proceedings. The Prosecuting Attorney's office also is responsible for the Berkeley County Victim's Assistance Program.

This program was created to assist victims of crime, in effort to ensure they are afforded fair and compassionate treatment throughout the judicial system process and protected from further victimization. Following today’s coordinated search warrant operation targeting v**e shops throughout Berkeley County, Berkeley County Prosecuting Attorney Joseph Kinser issued the following statement:

“This operation sends a clear message that businesses choosing to violate West Virginia law by selling illegal or restricted products to minors will be held accountable. Protecting our children remains a top priority for my office. I am proud of the outstanding cooperation among our local, state, and federal partners, and my office stands ready to prosecute those responsible for these violations.”

MARTINSBURG, W. Va. – Berkeley County Prosecuting Attorney Joseph R. Kinser announces that on Tuesday, May 26, 2026, MICHAEL ALLEN TAYLOR, 40, of Inwood, West Virginia, pleaded no contest in Berkeley County Circuit Court to the felony offenses of Second Degree Murder and Use of a Firearm During the Commission of a Felony. Taylor’s convictions are related to the January 2025 shooting death of John Offenstein.

Upon his convictions, the Honorable Judge Laura V. Faircloth sentenced Taylor to an aggregate fifty (50) years in prison. Restitution was also ordered in the amount of $2,350.20.

This matter was investigated by the Berkeley County Sheriff’s Department. Berkeley County Prosecuting Attorney Joseph R. Kinser and Berkeley County Chief Assistant Prosecuting Attorney Raymond E. Boyce, Jr. prosecuted the case.

Mr. Kinser would like to specifically thank Deputy D. Jenkins of the Berkeley County Sheriff’s Department Criminal Investigation Division for his thorough investigation in this case. Justice for the victim and his family could not have been achieved but for the diligence of Deputy Jenkins and the other officers who assisted his investigation.

MARTINSBURG, West Virginia – Berkeley County Prosecuting Attorney Joseph R. Kinser announces that on Tuesday, May 19, 2026, the May 2026 term of Grand Jury was convened at the Berkeley County Judicial Center. Grand Jury deliberations lasted through Thursday, May 21, 2026. Mr. Kinser announces that the Grand Jury returned a total of sixty-nine indictments for matters presented by the Berkeley County Prosecutor’s Office.

Indictments were returned against the following individuals for the following counts:

Reginald Lamont Alston, 46, of Martinsburg, West Virginia, was charged with Possession with Intent to Distribute Co***ne and Possession with Intent to Distribute Co***ne Base.

Ashley Nicole Artis, 41, of Hedgesville, West Virginia was charged with two counts of Parent, Guardian, Custodian, or Person in a Position of Trust Allowing S*xual Abuse to be Inflicted upon a Child.

Darrell Gene Artis, 51, of Hedgesville, West Virginia, was charged with seven counts of S*xual Assault in the First Degree, five counts of S*xual Assault in the Second Degree, five counts of S*xual Assault in the Third Degree, two counts of Use of Obscene Matter with the Intent to Seduce a Minor, and twelve counts of S*xual Abuse by a Parent, Guardian, Custodian, or Person in a Position of Trust.

Jeremiah David Barnes, 23, of Hedgesville, West Virginia, was charged with Person Prohibited from Possessing a Firearm.

Skyler Lyndon Bartles, 34, of Martinsburg West Virginia, was charged with Attempting to Disarm Law Enforcement Officer, Attempting to Flee Law Enforcement Officer on Foot, Obstructing, and Public Intoxication.

Dejion Devaul Bates, 26, of Baltimore, Maryland, was charged with Possession with Intent to Distribute Fentanyl and Possession with Intent to Distribute Co***ne.

Robert Augusta Bennett, 47, of Martinsburg, West Virginia, was charged with S*xual Assault in the Second Degree and In**st.

Clifton Maurice Bradley, 53, of Martinsburg, West Virginia, was charged with Third Offense for Driving Under the Influence of Alcohol and Third Offense Driving While License Revoked for DUI.

Bailey David Allen Brown, 22, of Bunker Hill, West Virginia, was charged with Domestic Battery Third Offense.

Jeremy Ray Brown, 46, of Falling Waters, West Virginia, was charged with Felony Fraudulent Scheme and Receiving Stolen Property.

Russell Lorenzo Brown, 68, of Martinsburg, West Virginia, was charged with Attempted Murder in the First Degree, four counts of Malicious Wounding, and Person Prohibited from Possessing a Firearm.

William Lee Brown, III, 41, of Martinsburg, West Virginia, was charged with Distribution of Co***ne Base, two counts of Distribution of Fentanyl, Conspiracy to Deliver Controlled Substances, and Distribution of Methamphetamine.

Logan Michael Burkett, 21, of Middletown, Maryland, was charged with DUI Resulting in Serious Bodily Injury and Driving with a Blood Alcohol Concentration of Greater than 0.15.

Jonathan Ray Cain, 44, of Hedgesville, West Virginia, was charged with counts of Concealing of a Child from Custodian and Conspiracy to Conceal a Minor Child from Custodian.
Rachel Leigh Daugherty, 33, of Martinsburg, West Virginia, was charged with Distribution of Co***ne Base, Distribution of Fentanyl, and Conspiracy to Deliver Controlled Substances.

Barbara Garnett Foulks, 42, of Gerrardstown, West Virginia, was charged with five counts of Concealing of a Child from Custodian and Conspiracy to Conceal a Minor Child from Custodian.
In a superseding Indictment, Derrell Chatay Frisby, 24, of Hagerstown, Maryland, was charged with First Degree Robbery, Conspiracy to Commit Robbery, two counts of Use or Presentation of a Firearm During the Commission of a Felony, Assault During the Commission of or Attempt to Commit a Felony, Malicious Assault, Conspiracy to Commit Malicious Assault, two counts of Wanton Endangerment, and two counts of Conspiracy to Commit Wanton Endangerment.

Shawn Patrick Granese, 34, of Martinsburg, West Virginia, was charged with Distribution of Methamphetamine, Conspiracy to Distribute Methamphetamine, Possession with Intent to Deliver Methamphetamine, Conspiracy to Possess with the Intent to Deliver Methamphetamine, Breaking and Entering, and Grand Larceny.

Sara Liann Hanna, 56, of Martinsburg, West Virginia, was charged with Possession with Intent to Distribute Co***ne and Obstructing an Officer.

Tiffany Renee Harris, 36, of Waynesboro, Pennsylvania, was charged with Distribution of Fentanyl and Conspiracy to Deliver Controlled Substances.

Chad Michael House, 35, of Martinsburg, West Virginia, was charged with Delivery of Fentanyl within 1,000 Feet of a School and Delivery of Xylazine.

Danielle Marie Hutzler, 41, of Martinsburg, West Virginia, was charged with Distribution of Methamphetamine, Conspiracy to Distribute Methamphetamine, Possession with Intent to Deliver Methamphetamine and Conspiracy to Possess with the Intent to Deliver Methamphetamine.

Shaquille Daquan Jackson, 30, of Glen Burnie, Maryland, was charged with Battery on a Government Representative, Offense by Inmate (Cause Bodily Injury or Resist Lawful Authority), and Willful Disruption of Governmental Process.

Kelda Kamapunga, 31, of Bunker Hill, West Virginia, was charged with Attempted Murder in the First Degree and Malicious Wounding.

Ian Dallas Kief, 36, of Falling Waters, West Virginia, was charged with Strangulation, Malicious Wounding, Domestic Battery Third Offense, and six counts of Violation of Protective Order.

Melissa Kaye Kirby, 55, of Martinsburg, West Virginia, was charged with eight counts of S*xual Abuse by Parent, Guardian, Custodian, or Person in a Position of Trust and eight counts of S*xual Assault in the Third Degree.

Morgan Mackenzie Landis, 34, of Martinsburg, West Virginia, was charged with two counts of Child Abuse Causing Bodily Injury, two counts of Domestic Battery, and Domestic Assault.

John Joseph Laurin, 28, of Hedgesville, West Virginia, was charged with Malicious Wounding, two counts of Domestic Battery, Domestic Assault, and Refusal to Fingerprint.

Matthew Ryan Maturo, 23, of Martinsburg, West Virginia, was charged with Felony Obtaining Money or Goods by False Pretenses and four counts of Felony Fraudulent Scheme.

Emmanuel Mario McCoy, 37, of Martinsburg, West Virginia, was charged with three counts of Distribution of Co***ne Base, Possession with Intent to Deliver Co***ne Base, Possession with Intent to Deliver Oxycodone, and Possession with Intent to Distribute Ma*****na.

Maurice Davaughn McMillan, 30, of Baltimore, Maryland, was charged with eight counts of Wanton Endangerment, Person Prohibited from Possessing a Firearm, Domestic Assault, and Fleeing from Law Enforcement Officer by Means Other than Use of Vehicle.

Kenneth Eugene Miller, II, 54, of Clearbrook, Virginia, was charged with Felony Fraudulent Scheme.

Justinian Frederick Mullins a/k/a Juggy, 36, of Martinsburg, West
Virginia, was charged with three counts of Possession with Intent to Deliver Methamphetamine, Distribution of Methamphetamine, Conspiracy to Distribute Methamphetamine, two counts of Conspiracy to Possess with the Intent to Deliver Methamphetamine, and violation of the Drug Kingpin statute.

Nicholas Alen Nichols, 18, of Martinsburg, West Virginia, was charged with Wanton Endangerment, Conspiracy to Commit Wanton Endangerment, and two counts of Contributing to Delinquency of a Child.

Katherine Ann-Austi O’Connell, 25, of Laurel, Maryland, was charged with Conspiracy to Deliver Co***ne Base, Conspiracy to Deliver Fentanyl, Transporting Co***ne Base into the State, Transporting Fentanyl into the State, and three counts of Child Neglect Creating Substantial Risk of Serious Bodily Injury.
Charles Edward Orrison, 54, of Hedgesville, West Virginia, was charged with Felony Leaving the Scene of an Accident Resulting in Death.

In a superseding Indictment, Michael Shae Palmer, 29, of Martinsburg, West Virginia was charged with seven counts of Domestic Battery Third Offense, two counts of Interfering with Emergency Communications, Attempted Strangulation, Fleeing in a Vehicle, Unlawful Taking of a Vehicle, three counts of Violation of Bail Condition, Fleeing on Foot, Obstruction, and Battery on a Law Enforcement Officer.

Robert Loranze Phipps, 34, of Martinsburg, West Virginia, was charged with Domestic Battery Third Offense, two counts of Domestic Assault Third Offense, and Child Neglect Creating Substantial Risk of Serious Bodily Injury.

Edward Donte Pollard, 30, of Baltimore, Maryland, was charged with Distribution of Co***ne, Possession with Intent to Deliver Fentanyl, Possession with Intent to Deliver Co***ne Base, Possession with Intent to Deliver Co***ne, and three counts of Conspiracy to Deliver Controlled Substances.

Gerald Doty Powell, 69, of Falling Waters, West Virginia, was charged with Felony Fraudulent Scheme and Felony Destruction of Property.

Michael Aaron Provenza, 43, of Martinsburg, West Virginia, was charged with Delivery of Methamphetamine within 1,000 Feet of a School and Possession with Intent to Deliver Methamphetamine.

Nijah Malik Abdul Rahim, 30, of Hagerstown, Maryland, was charged with Distribution of Fentanyl and Distribution of Xylazine.

James Lee Reed, 38, of Rockville, Maryland, was charged with Possession with Intent to Deliver Methamphetamine, Possession with Intent to Deliver Fentanyl, and two counts of Transporting a Controlled Substance into the State.

Brian Franklin Reedy, 33, of Hedgesville, West Virginia was charged with two counts of Burglary, Breaking and Entering, and Grand Larceny.

Jessica Leanne Rexrode, 36, of Martinsburg, West Virginia was charged with Abuse or Neglect of an Incapacitated Adult Resulting in Bodily Injury, Domestic Battery, Domestic Assault, and Interfering with Emergency Communications.

Mckinley Glenn Richardson-Bey, 27, of Baltimore, Maryland, was charged with Distribution of Co***ne Base, Distribution of Fentanyl, Conspiracy to Deliver Co***ne Base, Conspiracy to Deliver Fentanyl, Transporting Co***ne Base into the State, Transporting Fentanyl into the State, and three counts of Child Neglect Creating Substantial Risk of Serious Bodily Injury.

Kenneth Andrew Rogers, 56, of Martinsburg, West Virginia, was charged with Malicious Assault and Battery.

William Howard Shoup, 25, of Martinsburg, West Virginia, was charged with thirteen counts of Attempted Criminal Invasion of Privacy, thirteen counts of Harassment, and two counts of Possession of a Deadly Weapon on Premises of an Educational Facility.

In a superseding Indictment, Amanda Marie Terry, 32, of Martinsburg, West Virginia, was charged with Abuse or Neglect of an Incapacitated Adult, Conspiracy to Commit Abuse or Neglect of an Incapacitated Adult, Financial Exploitation of an Incapacitated Adult, and Conspiracy to Commit Financial Exploitation of an Incapacitated Person.

In a superseding Indictment, David Lewis Terry, 66, of Martinsburg, West Virginia, was charged with Abuse or Neglect of an Incapacitated Adult, Conspiracy to Commit Abuse or Neglect of an Incapacitated Adult, Financial Exploitation of an Incapacitated Adult, and Conspiracy to Commit Financial Exploitation of an Incapacitated Person.

William Travis Tolson, 45, of Inwood, West Virginia, was charged with Breaking and Entering, Grand Larceny, Arson in the Third Degree, and Misdemeanor Destruction of Property.

Patrick Dennis Weber, 37, of Falling Waters, West Virginia, was charged with Possession with Intent to Deliver Methamphetamine and Conspiracy to Possess with the Intent to Deliver Methamphetamine.

Victoria Faith Wenk, 22, of Hedgesville, West Virginia, was charged with Financial Exploitation of an Elderly or Incapacitated Person, Felony Fraudulent Scheme, and five counts of Fraudulent Use of an Access Device.

Kayla Renae Wolfe, 31, of Hagerstown, Maryland, was charged with Possession with Intent to Deliver Fentanyl, Possession with Intent to Deliver Co***ne Base, two counts of Conspiracy to Deliver Controlled Substances, Transporting Fentanyl into the State, and Transporting Co***ne Base into the State.

Asa Shariff Lavo Wright, 30, of Martinsburg, West Virginia, was charged with two counts of Distribution of Co***ne Base, Distribution of Fentanyl, Conspiracy to Deliver Controlled Substances, Possession with Intent to Distribute Fentanyl, and Possession with Intent to Distribute Co***ne Base.

Bertha Ziegler, 70, of Falling Waters, West Virginia, was charged with Child Neglect Resulting in Injury and Knowing Authorization of S*xual Abuse by a Parent, Guardian, Custodian or Person in a Position of Trust.

Robert Preston Ziegler, 58, of Falling Waters, West Virginia, was charged with five counts of S*xual Assault in the First Degree, thirty-two counts of S*xual Abuse by a Parent, Guardian, Custodian or Person in a Position of Trust, eight counts of In**st, twenty-three counts of S*xual Abuse in the First Degree, three counts of S*xual Assault in the Second Degree, three counts of S*xual Assault in the Third Degree, and five counts of Use of Obscene Matter with Intent to Seduce a Minor.

The Martinsburg Initiative presented the Drug Free Communities Officer of the Year Award yesterday to three outstanding officers in Martinsburg:

• Sergeant North of the West Virginia State Police
• Deputy Leake of the Berkeley County Sheriff's Office
• Patrolman Shank of the Martinsburg Police Department

Joseph Kinser, Berkeley County Prosecuting Attorney, was there to support and recognize these officers for their dedication and service to the community.

MARTINSBURG, W. Va. – Berkeley County Prosecuting Attorney Joseph R. Kinser announces that on Thursday, April 2nd, 2026, a Berkeley County jury found PAUL EDWARD RITENOUR, JR., 54, of Martinsburg, West Virginia, guilty of 24 offenses: twelve counts of S*xual Abuse by a Parent, Guardian, or Custodian; eleven counts of S*xual Assault in the 1st Degree (child under 12), and one count of S*xual Assault in the 2nd Degree.

Ritenour now faces a maximum sentence of three hundred and fifty-five to one thousand and forty (355-1,040) years in prison and fifty (50) years of supervised release thereafter. If released, Ritenour will also be required to register as a s*x offender for the remainder of his life. Ritenour is currently still serving a two to ten (2-10) year prison sentence for a 2023 Berkeley County conviction for Soliciting a Minor Via a Computer. It was the publicity surrounding that arrest and prosecution that prompted the victims in this case to come forward and disclose that the Defendant s*xually abused them as children.

Upon the return of the jury’s verdict, the Defendant was remanded to custody to await sentencing. A sentencing hearing is scheduled for June 11, 2026, at 11:00 a.m. The three-day trial was held before the Honorable Judge Debra MH McLaughlin of the 27th Judicial Circuit.

This case was investigated by Lieutenant F.H. Edwards of the West Virginia State Police and the case was prosecuted by Berkeley County Prosecuting Attorney Joseph R. Kinser and Assistant Prosecuting Attorney Megan Yates.

Mr. Kinser would like to specifically thank the jury for listening to the victims in this case, who have waited far too long for justice, and for carefully weighing the evidence in arriving at their verdict.

“Crimes against children are some of the most serious crimes we prosecute in Berkeley County and I’m glad we were able to achieve justice for these victims, now adults, who have had to live with this abuse for years,” said Kinser.

MARTINSBURG, W. Va. – Berkeley County Prosecuting Attorney Joseph R. Kinser announces that on Tuesday, February 24, 2026, BRANDON RUSSELL WARREN, 33, of Martinsburg, West Virginia, was sentenced to the maximum 260.5–908 years in prison, to be followed by the maximum 50 years of supervised release and lifetime s*x offender registration. With credit for time already served, Warren will be eligible to seek parole in April 2283, when he is 291 years old.

Warren’s sentence reflects his convictions for 53 offenses related to s*xual abuse of multiple children; the solicitation, possession, and distribution of child s*x abuse material; and in**st resulting from the verdict in a seven-day jury trial conducted in November. Warren was additionally ordered to pay $20,000 in fines. Restitution, although also ordered, will be finalized at a later date. The Honorable Laura V. Faircloth presided over the case. Berkeley County Prosecuting Attorney Joseph R. Kinser and Chief Assistant Prosecuting Attorney Raymond E. Boyce, Jr. prosecuted the case.

As Mr. Kinser has always prioritized the safety of Berkeley County’s children, he thanks those whose contributions to this case removed a predator from our streets. Specifically, Mr. Kinser would like to thank Sgt. See and First Sgt. Edwards, West Virginia State Police Crimes Against Children Unit; Dep. Weidman and Sgt. Funk, Berkeley County Sheriff’s Department Criminal Investigation Division; and Lt. Albaugh, Martinsburg Police Department. Mr. Kinser also thanks former Assistant Prosecuting Attorney Kate Harding for her investigative contributions as well as her preparative efforts.

Lastly, Mr. Kinser thanks the survivors in this case. Because of their remarkable courage, justice was done not only for them, but also for the community.
