Does My Family Member Need Guardianship?

Before taking a step as significant and permanent as guardianship, it’s important to explore all available options.

Alternatives like Supported Decision-Making can help people with disabilities make their own choices while still receiving guidance from trusted people in their lives.

Supported Decision-Making:
• Promotes independence and respects each person’s dignity and preferences
• Is less restrictive than guardianship
• Can be tailored to the specific support needs of the individual
• Helps families, educators, and supporters think through options before pursuing guardianship

We are proud to have collaborated on SC Supported Decision Making, a resource hub full of tools, examples, and guidance to help families understand and use Supported Decision-Making in South Carolina.

A new Partner Toolkit is now available through the Developing Decision Makers grant, funded by the SC Developmental Disabilities Council.

This toolkit includes educational information and worksheets for students, families, teachers, and partners on Supported Decision-Making, alternatives to guardianship, assuming capacity, autonomy support, and student-led IEPs.

We love seeing our team out in the community!

Our Director of Operations, Derek Smoot, had the opportunity to serve as a judge for Pathwise’s Celebrity Showcase in Laurens County, and it looks like it was such a fun and meaningful event.

Thank you to Pathwise, formerly Laurens County Disability Board, for creating opportunities that celebrate talent, connection, and community. We were glad to be part of it!

Students with disabilities deserve strong, clear protections — and families deserve systems that are easy to understand and access.

The Arc of South Carolina has joined disability, civil rights, and education organizations across the country in opposing the proposed transfer of key federal education and civil rights functions out of the U.S. Department of Education.

These offices help oversee important protections connected to special education, Section 504, vocational rehabilitation, and civil rights in schools. Moving these responsibilities to other federal agencies could create confusion for families, weaken coordination, and make it harder for students with disabilities to receive the support and protections they are entitled to.

Special education should remain connected to the broader education system. Students with disabilities are students first, and their rights, services, and opportunities should not be separated from the agencies responsible for education.

The Arc of SC will continue to advocate for policies that protect students with disabilities, support families, and preserve strong federal accountability.

The Supreme Court has already decided that living in the community is a legal right.

More than 25 years ago, the Supreme Court’s Olmstead decision affirmed that people with disabilities have the right to live in their communities and not be forced into institutions.

That ruling changed millions of lives. But a right on paper only works when people can get the support they need. That’s what Medicaid home and community-based services (HCBS) make possible.

Congress made the biggest cuts to Medicaid in history last year. Now, many states are considering options that could reduce access to HCBS.

Help keep the promise of Olmstead alive. Tell Congress to protect Medicaid HCBS and the right of people with disabilities to live in their communities. https://bit.ly/4fAVl54
