Officers responded to 578 calls for service, which included investigations into 39 motor vehicle accidents, 18 domestic violence incidents, and 3 drug overdoses, including 1 fatal overdose. City Treasurer Arrested Following Financial Investigation

October 21, 2025 – Johnstown, NY

The Johnstown Police Department has concluded an investigation into City Treasurer Thomas Herr. As a result, Herr was arrested and charged in Johnstown City Court with the following offenses:

• One count of Official Misconduct (A misdemeanor)
• One count of Falsifying Business Records in the First Degree (Class E felony)
• One count of Grand Larceny in the Third Degree (Class E felony)

The investigation began after City officials received several notices from the New York State and Local Retirement System, alerting them to missed payments totaling $1,576,193, which were due on February 1, 2025. The missed payments resulted in fines of approximately $23,600 against the City of Johnstown.

During an internal review, officials discovered multiple cash envelopes in the Treasurer’s Office that had been submitted by residents as payments to the City. Although office records showed these funds as deposited, several envelopes contained missing or incomplete cash amounts. Further investigation revealed a pattern in which cash from one payment was taken and later replaced using funds from subsequent payments. The missing money had been taken for personal use by Herr.

When investigators identified over $6,000 in missing and misappropriated funds, City officials were notified, and the Johnstown Common Council acted to remove Herr’s signatory authority.

The investigation into City accounts also revealed numerous transactions that were either missing from the City ledger or recorded incorrectly. The City’s bank accounts had not been reconciled since April 2024. Working with an outside accounting firm, investigators identified 88 transactions totaling more than $554,000 that required documentation to verify their accuracy, these funds have been cleared as not being fraudulent. The City will continue collaborating with the accounting firm until all accounts are fully reconciled.

Herr was processed and released pending his appearance in Johnstown City Court to be arraigned on the aforesaid charges.

Two (2) people were taken into custody under the Mental Hygiene Law of the State of New York.
