At the times when Romero allegedly registered to vote, neither federal nor Indiana law required proof of citizenship for him to do so. Federal law has been interpreted effectively to prohibit states from requiring documentary proof of citizenship for individuals who register using federal forms. Romero was able to register simply by completing a form that stated he was a citizen.

Had the SAVE America Act been in place, all voters would be required to provide documentary proof of citizenship such as a birth certificate or passport. Noncitizens would not be able to do so and therefore would not be able to register to vote in federal elections.

This case shows exactly why we need Congress to do its job and act immediately to pass this common-sense legislation.

If a simple checkbox is enough for an illegal alien to register and vote in election after election, then others could easily do so as well, and many have across the country. And if it’s happening in a state like ours, which has strong photo ID laws, imagine how rampant it is in a state like California, where basically nothing is done to safeguard its elections.

🚨My team and I, in partnership with Vigo County Prosecutor Terry Modesitt, have filed felony charges against Francisco Aguilar Romero, an individual who is allegedly an illegal alien, for unlawfully registering to vote, committing perjury, and casting ballots in multiple Indiana elections. The charges mark the first time Indiana has prosecuted an illegal alien for the crime of illegal voting.

According to the allegations in the charging papers that we filed, Romero was born in Mexico, is in the United States illegally, and holds DACA status. State records show he voted in the 2018 General Election, the 2019 Municipal Election, the 2020 General Election, the 2022 General Election, the 2023 Municipal Election, and the 2024 General Election—all in Vigo County. He allegedly first registered to vote in February 2018 and later updated or re-verified his registration in August 2023.

Two years ago, I started a process to verify the citizenship status of registered voters in Indiana and was successful in obtaining that data from the federal government. Now, we are acting on that information and it’s certainly not the end of our enforcement. This critically important prosecution is just another step in the work I’ve been doing ever since I was Secretary of State, when I led the effort that made Indiana the first state in the nation to enact a photo voter ID law.

A complaint, indictment, and information merely contain accusations. All defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.

Had a great afternoon with the Plainfield Chamber of Commerce. Thank you to Executive Director Tim Weigel and all the members who help keep Indiana’s economy strong.

It was especially encouraging to meet Cascade High School’s Next Gen Chamber students Reese Walters and Cole McMurran. Congrats to Cascade High School on the $10,000 grant from the Plainfield Chamber of Commerce and Hendricks College Network to launch a student-led enterprise—the future of Indiana business is in good hands.

Protecting the conditions that let efforts like this succeed is core to what our office does every day. They’ll never admit it, but they screwed up when they fired Ryan Grigson, who never had a losing season, always had the team in the hunt, and was only given one head coach. Ballard was allowed to go through several. They anointed Ballard the “greatest GM hire of the 21st century,” but they failed to realize that acquiring talent means nothing without accountability or a culture focused on winning. Instead, they focused on media access, being popular, and being politically correct. Ten years with zero to hang their hat on. Not even a single division title. Here's a prediction: they’ll now ask for a new stadium or threaten to leave.

Indiana law is clear: Local police chiefs and sheriffs can enter into 287(g) agreements with ICE.

Our office confirmed that the Stinesville Police Department’s agreement is fully lawful. Town Board approval isn’t required for a local police department to enter into a 287(g) agreement, and any attempt to restrict or withhold funding to block cooperation with federal immigration authorities is illegal.

These agreements give local law enforcement tools to better police their communities and opens up many opportunities to obtain federal funding. We’ve already signed our own 287(g) agreement, and we strongly encourage every Indiana sheriff and police department to do the same — doing so helps protect Hoosiers and make our communities safer.

Today, our office and 15 other states filed an amicus brief in support of parents raising religious objections to their child’s vaccination.

Parents have the fundamental right to raise their children according to their faith, especially in their own home, and the government should respect that.
