Summary of Notarial Duties:
*Performs notarial acts only in the state he/she is commissioned in;
*Ensures current contact information is up to date with the Secretary of State (SOS);
*Successfully completes notary course and passes examine administered by SOS;
*Utilizes Remote Online Notarization (RON) platforms approved by SOS;
*Properly identifies the individual requesting notarization every time a notarial act is performed face to face or audio visual RON platform;
*Ensures all signers are competent, aware and not under duress;
*Ensures there is a notarial certificate or wording for each document notarized and only completes certificates that have been lawfully prepared;
*Ensures notarial stamp contains the name of the notary public, the title "Notary Public", the state, city/county and commission expiration date unless date is affixed to certificate;
*Does not exceed notarial fees set by the SOS;
*Records every notarial act in journal;
*Maintains notarial journal(s) for at least 10 years;
*Serve as an official witness, administer an oath or affirmation and/or take an acknowledgement. If a notarial certificate is absent from a document, the notary can only serve as an official witness.
*Properly secures all notarial tools and report to the SOS if they are lost or stolen;
*Should refrain from performing notarial acts for immediately family members and any acts that personally involve or benefit the notary in the outcome of the document.
*Refrains from providing any form of legal advice.
*Does not advertise notarial service under a trade name. The public needs to know the name of the person he/she receives services from
