Dear friends and supporters of Pah Tempe Hot Springs,
last Friday, February 1st at the Federal Court in Salt Lake City Ken presented our case for protection from sale of Pah Tempe property
The first Judge, ruled against us, which was somewhat expected.
The Appellate Judge ruled that we have until a March 5th rehearing to convince the Court that the merits (arguments) of our case are valid. If the Court is convinced, the Judge indicated that he then would continue the stay ( "freeze") on all items relating ti the foreclosure sale of the property.
At the close of the second hearing the opposition made every effort to impose additional restrictions on us during this period before March 5th. The most personal was their complaint that we are entertaining guests at the Springs and therefore making some money. So in compromise, Judge Walloups decided that during this period until March 5th we must be entirely closed to the public.
Perhaps this is really a blessing in disguise. Hopefully this period of no public access, will stimulate greater concern by those who love, enjoy and appreciate this sacred national treasure.
Now we have a fixed deadline that must be met in order to win our objective to permanently protect these healing waters for all time to come.
Please call for more detailed information if you are interested (435 635 2879). This is a daunting challenge. We are confident that we can and will meet and prevail.
So in summary, all public open house gatherings and all private sessions are cancelled until further notice. This is the Judge's order and must be followed to the letter !!!
We need your help and support in these difficult times.
We are so grateful for all the years of past support that you all have so freely given. We will succeed with your prayers, good thoughts and dedicated support. As always we love the Hot Springs and joy into your continued efforts to permanently save this God given treasure.
The proceedings in the Courts were quiet amazing. Ken, all by himself, presenting Pah Tempe Hot Springs against 6 different attorneys, some there in person, some on the screen, out of St George. The first Judge, was in New York and ruled from there by phone.
That's all for now. We wish you all a good week and send you greetings and blessings to all,
Ken and Co
