Wilderness Preserve US LP (Wilderness) appeals the September 19, 2025 Orders of the Montana Nineteenth Judicial District Court, Lincoln County, denying Wilderness’s motion to alter or amend the judgment or grant a new trial in the alternative, and awarding McNain Holdings LP, Jay Robert Blake (Jay), and Naomi Monica Blake (Naomi) (collectively the Blakes) their attorney fees and costs. Tom McNain (Tom) and Corie McNain (Corie) (collectively the McNains) are the sole partners of McNain Holdings LP. We restate and address the following issues:

Issue 1: Whether the District Court erred by concluding that sufficient evidence supported the jury’s verdict.

Issue 2: Whether the District Court erred by awarding the McNains and Blakes their attorney fees and costs.

We affirm and remand for further proceedings concerning the attorney fees and costs incurred on appeal.

T.J.S., birth father of A.M.S., appeals the June 12, 2025 Decree Terminating Parental Rights and Decree of Adoption issued by the Eleventh Judicial District Court, Flathead County. The District Court’s order terminated the parental rights of T.J.S. and granted the petition filed by A.M.N.L., birth mother of A.M.S., and Q.O., birth mother’s partner, for Q.O. to adopt A.M.S.

We address the following restated issues on appeal:

1. Whether the District Court committed reversible error when it permitted the parties to stipulate that ICWA did not apply.

2. Whether the District Court abused its discretion by not granting a second continuance of the termination hearing.

3. Whether the termination of T.J.S.’s parental rights must be reversed due to ineffective assistance of counsel.

We affirm.

The National Order of Cowboy Rangers (Rangers) appeal from the Thirteenth Judicial District Court’s dismissal of its petition for judicial review (Petition) of the Department of Revenue’s (Department) denial of the Rangers’ application for a fraternal all-alcoholic beverage license. The District Court held the Rangers’ Petition was untimely. Rangers argue the Department was late in issuing its decision, and they experienced delays in obtaining counsel for the court case. Rangers assert the District Court erred in dismissing its Petition without a hearing, and failing to entertain its equitable reasons for delay in filing its Petition. We affirm.

Robert Jackson Jore (Jore) appeals the District Court’s Judgment on First Revocation entered August 8, 2024, which revoked his suspended sentence for Driving Under the Influence of Alcohol or Drugs, Fourth or Subsequent Offense, and sentenced him to three years in the Montana State Prison (MSP) with credit for one day of jail time. Jore contends the District Court erred by failing to award him 276 days of elapsed (street) time credit under § 46-18-203(7)(b), MCA. For the reasons set forth below, and consistent with this Court’s recent decisions in State v. Pajnich, 2025 MT 101, 422 Mont. 12, 568 P.3d 562 and Williams v. Green, 2025 MT 102, 422 Mont. 17, 568 P.3d 549, we affirm.

Charles G. Lane appeals his judgment of conviction, entered after a jury trial, of criminal possession of dangerous drugs pursuant to § 45-9-102, MCA. Lane challenges the sufficiency of the evidence to support his conviction and the failure of the judgment to provide credit for time served in the amount of 133 total days, rather than the 33 days awarded. The State concedes that Lane is entitled to a credit for time served of 133 days toward his sentence.

Janine Ann Samuel appeals the February 23, 2026 Order Denying Petition for Grandparent-Grandchild Contact entered by the Thirteenth Judicial District Court, Yellowstone County. Janine contends the District Court relied on clearly erroneous findings, misapplied § 40-9-102, MCA, failed to assess C.S.’s best interests, and denied her a fair hearing. Alexis Tawnya Samuel did not file an answer brief. Her failure to do so does not entitle Janine to reversal by default. A district court’s decision is presumed correct, and the appellant bears the burden of establishing reversible error. In re Marriage of McMahon, 2002 MT 198, ¶ 7, 311 Mont. 175, 53 P.3d 1266. We therefore review Janine’s claims under the applicable standards of review and on the record presented. We restate the dispositive issue as whether the District Court erred by denying Janine’s petition for court-ordered contact with C.S. We affirm.
