Covenant Enforcement would like to remind residents that portable basketball hoops are not allowed to be placed in or on the public right-of-way which means the street or sidewalks. Blocking the right-of-way is considered a violation, not only of the District's covenants, but also the City of Fountain's Ordinance, both of which provide the authority to require removal and impose fines. Please take the time to remove your basketball hoop off the sidewalks and streets. Do not let them hang over the sidewalk if they are on the driveway because this blocks the smooth flow of pedestrian traffic. Do not lay them down in the rocks but keep them stored out of view when not in use.
Enforcement will begin again after a considerable lapse time of non-enforcement.
Guidelines for basketball hoops (portable and permanent) can be found in the District's Rules and Regulations, Page 11 ... "No basketball backboards may be attached to a structure. Freestanding basketball backboards must be made of standard manufacturer materials and colors. Temporary, portable basketball backboards and poles may not be used within public streets and must be stored out of view from adjacent properties and streets except when in use."
Concerns have been raised regarding motorized motorcycles and motorbikes being driven on the sidewalks. Our covenants do not cite this specific concern; however, the Fountain City Ordinances state, "Police Action: The Fountain Police Department is actively targeting illegal motorcycles and motorbikes due to high public complaints regarding danger and noise. Consequences: Unauthorized use can result in fines, summons, and potential impoundment. Pedestrian Safety: City regulations explicity prohibit motorized vehicles on sidewalks, prioritizing public safety. If you see violations occurring, contact the Fountain Police Department.
