BREAKING🚨 A federal judge in D.C. has once again stepped in to stop Trump from forcing transgender women into men’s prisons — calling out his administration’s anti‑trans policy as likely unconstitutional and dangerous.
Trump’s Executive Order 14168, signed on his first day back in office, ordered the federal government to recognize only “biological sex,” barred gender‑affirming health care in federal custody, and told the Bureau of Prisons to move all trans women into men’s facilities.
Three incarcerated trans women sued in Doe v. Blanche, arguing that the policy violates the Eighth Amendment ban on cruel and unusual punishment and the Equal Protection Clause. They backed it up with mountains of evidence: trans women in men’s prisons are dramatically more likely to be beaten, r***d, and denied basic medical care.
U.S. District Judge Royce Lamberth first issued a temporary restraining order in early 2025, blocking the moves for those plaintiffs and ordering BOP to keep them in women’s facilities and continue their hormone therapy. When the administration tried again after a partial appeals‑court win, Lamberth just renewed his injunction.
His latest order — issued this week — once more bars BOP from transferring the women to men’s prisons and forces the government to maintain their pre‑Trump housing and medical care at least through early June, while the case continues.
That means Trump’s team doesn’t get to hide behind legal technicalities. The judge has already signaled that forcing trans women into men’s prisons, cutting off their gender‑affirming care, and pretending that “biological sex” is the only thing that matters likely violates the Constitution.
He cited evidence that trans women are a uniquely vulnerable population and that treating them this way is not about safety — it’s about ideology and cruelty.
This isn’t just about three women. Because of Lamberth’s orders and related cases, at least 17 incarcerated trans women are currently shielded from Trump’s policy, and over 1,000 trans prisoners nationwide are still guaranteed access to hormone therapy while litigation plays out.
Every renewed injunction buys them time — time without being thrown into men’s units where the risk of assault skyrockets, time to keep the medical care that keeps them alive.
Trump loves to scream that he’s “protecting women” by erasing trans women. What this case exposes is the truth: his policy would take some of the most vulnerable women in the system and deliberately lock them in with men who have a documented history of violence, then strip away their healthcare. That’s not protection. It’s state‑sanctioned abuse.
The courts aren’t always heroes. But on this one, a federal judge looked at Trump’s order and said: not so fast. Trans women are not bargaining chips in your culture war. They are human beings with constitutional rights.
