NOTICE TO FARMERS

The Martin County Highway Department will soon begin spot spraying for noxious w**ds in county road ditches. The w**d spray the County uses is non-toxic to livestock. It is recommended to wait 14 days after spraying to allow the chemicals to work. Anyone wishing to maintain road ditches for hay crop must pick up small signs at the County Highway Department Shop in Fairmont or indicate on our County road map areas not to be sprayed. Please notify us each year of these areas (507-235-3347) or email: [email protected] “No Spray” areas are the individual’s responsibility for keeping the ditches free of noxious w**ds and should be mowed before thistles go to seed.

If you plan to harvest ditch hay to feed to livestock, it is your responsibility to either mark those ditches as “no spray” or to keep track of where you spread the manure from the livestock that is fed with that ditch hay. The chemical that the county uses to spray thistles can have a residual effect on soybean crops in manure from an animal fed with sprayed ditch hay, even after the chemical passes through the livestock’s digestive track. Anyone wishing to view the chemical’s product label should contact the Highway Department.

PUBLIC HEARING NOTICE

The Martin County Planning Commission/Board of Adjustment will be conducting a public hearing on May 26, 2026 at 5:30 p.m. The hearing will be held in the Martin County Commissioners Room, located on the first floor of the Courthouse, 201 Lake Avenue – Fairmont, MN. The following item will be on the agenda:

Variance Request from Bradley Schmidt within Section 22 of Lake Belt Township. Bradley Schmidt is proposing to construct a new home and driveway which will be located closer than the minimum required setback to the ordinary high-water level and closer than the minimum required setback from the road right of way in an “SL-1” Special Protection District. The Martin County Zoning Ordinance requires a 200-foot setback from the ordinary high-water level and 50-foot setback from the road right in an “SL-1” Special Protection District.

The above hearing is open to you and any interested persons at which time you may appear if you so desire, either in person or by agent or attorney, in opposition to or in support of the request. The hearing of this request is not limited to those receiving copies of this notice, and if you know any neighbor or affected property owner who for any reason has not received a copy, it would be appreciated if you would inform them of this hearing.

GENERAL NOTICE TO CONTROL OR ERADICATE NOXIOUS WEEDS

Notice is hereby given this 8th day of April, 2026 pursuant to Minnesota Statutes, Section 18.83, Subdivision 1 (2009), that all persons in Martin County, Minnesota, shall control or eradicate all noxious w**ds on land they occupy or are required to maintain. Control or eradication may be accomplished by any lawful method, but the method(s) applied may need to be repeated in order to prevent the spread of viable noxious w**d seeds and other propagating parts to other lands. Failure to comply with the general notice may mean that an individual notice, Minnesota Statutes, Section 18.83, Subdivision 2 (2013), will be issued. An individual notice may be appealed within two working days of receipt to the appeal committee in the county where the land is located. Failure to comply with an individual notice will mean that the inspector having jurisdiction may either hire the work done or seek a misdemeanor charge against the person(s) who failed to comply. If the work is hired done by the inspector, the cost can be placed as a tax upon the land and collected as other real estate taxes are collected. You may obtain a list of the plants that are designated as noxious w**ds and the members of the appeal committee from your County Agricultural Inspector or County Designated Employee. You can also obtain this information from your Local W**d Inspectors. Local W**d Inspectors include the township supervisors, city mayors or their appointed assistants. PLANTING, PLOWING & DRIVEWAYS IN COUNTY RIGHT-OF-WAY

Please be advised that planting and plowing within the highway right-of-way as well as depositing field rocks is in violation of Minnesota Statute 160.27, as is removing, injuring or displacing right-of-way markers.

Also, all field and farm entrances built off a county roadway must have a permit from the Martin County Highway Department. If culvert is needed in entrances, it must be new corrugated metal pipe. Please call 507-235-3347 before building any field and farm entrances.

Violations of either of the above is a misdemeanor and may be subject to criminal and/or civil penalties.

PUBLIC HEARING NOTICE

The Martin County Planning Commission/Board of Adjustment will be conducting a public hearing on March 24, 2026 at 5:30 p.m. The hearing will be held in the Martin County Commissioners Room, located on the first floor of the Courthouse, 201 Lake Avenue – Fairmont, MN. The following item will be on the agenda:

Conditional Use Permit from Caleb Benes within Section 21 of Fairmont Township. Mr. Benes is proposing to relocate his monument business onto his existing farmstead in an “A” Agricultural District. The Martin County Zoning Ordinance requires a Conditional Use Permit in an “A” Agricultural District for any non-agricultural related retailers and/or businesses on existing farmsteads.

Variance Request (After the Fact) from Federated Rural Electric Association within Section 1 of Tenhassen Township. Federated Rural Electric Association has constructed a broadband utility shed that is an accessory building permitted in a “A” Agricultural District encroaching closer than the minimum required setback from the centerline of the public right-of-way in an “A” Agricultural District. The Martin County Zoning Ordinance requires a two hundred (200) feet setback from the centerline of any public right-of-way for a new building site effective February 17, 2004 and one hundred and thirty (130’) feet from the centerline of any public right-of-way for existing building sites constructed before February 17, 2004. Existing building sites cannot further encroach closer than the nearest present building from the centerline of the road provided greater than one hundred and thirty (130’) feet from the centerline in an “A” Agricultural District.

WARNING TRUCKERS / FARMERS

Load restrictions of 10,000 pounds on any single axle are imposed on all Township and County roads in Martin County beginning March 3, 2026. These restrictions are imposed by law on all Township and County roads and posting with signs is not required.

To impose different weight restrictions on any road, such roads will be posted and the posted restrictions will govern.

Public Input Wanted as Martin County
Updates Hazard Mitigation Plan

Martin County residents, community leaders, business owners, area agencies and organizations now have an opportunity to share how severe weather events impact their property and lives. There is also an opportunity to share their ideas on how to reduce local impacts in the future.

The Martin County Office of Emergency Management is working with U-Spatial at the University of Minnesota Duluth to update the county’s Hazard Mitigation Plan (HMP). The plan assesses the natural hazards that pose risk to the county, such as flooding, tornadoes, windstorms, winter storms, extreme temperatures, wildfire, and drought. The plan further identifies local vulnerabilities and ways to minimize damage from future events. As the county works to update the plan, it wants to hear from the public.

The Martin County HMP is a multi-jurisdictional plan that covers Martin County, including all cities and townships within the county. The Martin County HMP also incorporates the concerns and needs of school districts, watershed districts, and other related agencies, organizations, or businesses participating in the planning process. The plan will be updated by a planning team made up of representatives from county departments, local municipalities, and other key stakeholders. When completed, the plan will be submitted to the Minnesota Department of Homeland Security and Emergency Management and the Federal Emergency Management Agency (FEMA) for approval.

“Hazard mitigation planning is a central part of our emergency management program,” said Ben Johnson, Martin County Emergency Management Director. “Understanding the natural hazards that can cause serious impact to our communities and taking action to reduce or eliminate the impact of future disasters makes us more resilient. Hazard mitigation helps us to break the cycle of damage and repair caused by things like flooding, ice storms, and severe wind events that can damage property, stress economies, and threaten life safety in our county.”

Examples of hazard mitigation include:

• Conducting public outreach on severe weather awareness and preparedness
• Improving stormwater management systems to better handle high-rain events
• Removing existing buildings from flood or erosion prone hazard areas
• Increasing defensible space around homes in high-risk wildfire areas
• Constructing tornado safe rooms in vulnerable areas such as mobile home parks
• Burying overhead powerlines that may fail due to heavy snow, ice, or windstorms

Some mitigation activities may be eligible for future FEMA Hazard Mitigation Assistance grant funding.

As part of the planning process, gathering input from the public is an important and required step. Residents of cities and townships, local businesses, and other stakeholders are encouraged to share feedback on the following to incorporate into the plan:

• What are the natural hazards you feel pose the greatest risk to your community?

• Are there specific populations or assets in your community that you feel are more vulnerable to future storm events?

• What concerns do you have, and what sorts of actions do you feel would help to reduce damages of future hazard events in your community or the county as a whole?

To provide your feedback, please contact Martin County Emergency Management or submit your comments via the online HMP public feedback form.

There will be additional opportunities for public feedback throughout the planning process. A draft of the plan will be made available for public review prior to submission of the plan to the State of Minnesota. Future news releases will be shared with the media to notify the public of these opportunities.

The Federal Disaster Mitigation Act of 2000 (DMA 2000) requires counties to update their plan every 5 years to maintain eligibility for FEMA’s Hazard Mitigation Assistance (HMA) grant programs.
