Resolution on Unconstitutional Federal Power, Executive Overreach, and Institutional Abuse
Libertarian Party of Humboldt County
Whereas, the purpose of government, if it exists at all, is limited to the protection of individual rights to life, liberty, and property, and any power exceeding that purpose is illegitimate;
Whereas, the Constitution of the United States enumerates and constrains federal authority, reserving all non-delegated powers to the states and the people;
Whereas, across multiple administrations of both major political parties, federal agencies, statutes, and executive actions have repeatedly exceeded constitutional limits, eroded due process, and operated with diminished judicial accountability;
Whereas, the concentration of coercive power in unelected federal agencies enables systemic abuses regardless of the political ideology or intentions of the officials temporarily in charge;
Whereas, doctrines such as qualified immunity, administrative deference, emergency powers, and expansive executive discretion have been used to shield unconstitutional conduct from meaningful review and redress;
Whereas, agencies including, but not limited to, Immigration and Customs Enforcement (ICE), U.S. Customs and Border Protection, the Bureau of Alcohol, To***co, Fi****ms and Explosives (ATF), the Drug Enforcement Administration (DEA), the Federal Bureau of Investigation (FBI), and others have exercised enforcement powers that extend beyond constitutionally enumerated authority, often with diminished judicial oversight and accountability;
Whereas, unconstitutional laws—including but not limited to civil asset forfeiture statutes, warrantless surveillance authorities, federal drug prohibitions, and regulatory criminalization—create incentives for rights violations independent of who holds executive office;
Whereas, history demonstrates that powers normalized under one administration are inevitably expanded or weaponized under future administrations;
Therefore, be it resolved, that the Libertarian Party of Humboldt County condemns all unconstitutional exercises of government power, regardless of political party, administration, or stated intent;
Be it further resolved, that the Libertarian Party of Humboldt County rejects the legitimacy of any federal agency, law, or executive action that violates due process, exceeds enumerated powers, or infringes upon individual rights;
Be it further resolved, that the Party calls for the repeal, defunding, restructuring, or abolition of unconstitutional agencies and statutes, and for the restoration of strict judicial oversight, individual accountability, and constitutional limits on government power;
Be it further resolved, that no individual officeholder, agency employee, or government institution shall be exempt from accountability under the law, and that immunity doctrines inconsistent with equal justice are incompatible with a free society;
Be it finally resolved, that the Libertarian Party of Humboldt County affirms that liberty is threatened not by the identity of those in power, but by the existence of unchecked power itself, and commits to opposing authoritarianism in all its forms, without exception or favoritism.
