Judge R. Chris Phelps is now serving as Chief Judge of the Superior Courts of the Northern Judicial Circuit, which covers Elbert, Franklin, Hart, Madison and Oglethorpe County. Judge Phelps began his service as Chief Judge on July 1, succeeding Judge Jeffery S. Malcom, who is retiring from full-time judicial service at the end of this year.

“I want to express my appreciation to Judge Malcom for his leadership during his service as Chief Judge,” Phelps said, “particularly for successfully navigating the courts of the Northern Circuit through the years of the COVID-19 pandemic. I also want to acknowledge and give credit to the bailiffs, security teams and Clerks of Superior Court in each of our five counties for the services they render to our justice system.”

Judge Phelps was appointed to the Superior Court bench in January 2015 by Gov. Nathan Deal and was elected to full four-year terms in 2016, 2020 and 2024.

JUDGE PHELPS TO HEAR GEORGIA SUPREME COURT CASE

Superior Court Judge R. Chris Phelps of the Northern Judicial Circuit has been designated to serve in place of Justice Britt C. Grant in the appeal of The State v. Davis (S17G1333). The Supreme Court of Georgia will hear arguments in the case on Dec. 11, 2017 during its 10:00 A.M. session. In this Chatham County case, the State is appealing a Georgia Court of Appeals decision that allows a convicted child molester, who was later pardoned by the Georgia Board of Pardons and Paroles, to be released from the requirement that he register as a s*x offender. In addition to hearing arguments, Judge Phelps will participate in the Court’s decision.

Judge Phelps, 65, was appointed to the Superior Court of the Northern Judicial Circuit by Gov. Nathan Deal on March 4, 2015. The Northern Judicial Circuit includes Elbert, Franklin, Hart, Madison and Oglethorpe counties. In May 2016, he was elected to a full six-year term. Prior to his appointment to the bench, he was engaged in private practice for 38 years.

Judge Phelps is a native of Elberton, GA and graduated magna cm laude from the University of West Georgia in 1973. He received his Juris Doctor degree from the University of Georgia School of Law in 1976.

Judge Phelps represented the attorneys of the Northern Judicial Circuit on the State Bar Board of Governors for 32 years. In 2016, he was presented with the State Bar of Georgia’s Distinguished Service Award. He has been a Scoutmaster for Boy Scout Troop 127 in Elberton for 39 years, during which time 51 of the Troop’s scouts have earned the Eagle Scout Award.

Judge Phelps has been married to his high school sweetheart, Pamelia Jo Gaines Phelps, for 43 years. They have two children and four grandchildren.

(Designated judges are appointed when a justice must recuse himself or herself from a particular case. The Supreme Court of Georgia maintains a list of select judges from around the state and when the need arises, the Court appoints the next judge on the list.)

Judge Chris Phelps Receives State Bar of Georgia Distinguished Service Award

Amelia Island, Fla. – Northern Judicial Circuit Superior Court Judge R. Chris Phelps of Elberton was honored with the 2016 Distinguished Service Award, presented by the State Bar of Georgia during its Annual Meeting on June 18.

Phelps was honored for his extensive service to the legal profession, the justice system and the public during his four-decade career as an attorney and judge. He recently completed 32 years of continuous service on the Board of Governors of the State Bar of Georgia, representing the attorneys of the Northern Circuit, which includes Elbert, Franklin, Hart, Madison and Oglethorpe counties.

He also served on the Finance Committee of the 48,000-member State Bar for 20 years and as its chairman for 12 years. He previously served as chair of the Review Panel of the State Bar Disciplinary Board, the Continuity of Law Practice Committee, the Programs Committee and the Bar Governance Committee of the State Bar.

A lifelong resident of Elberton, Phelps was engaged in the general practice of law for 38 years prior to being appointed by Gov. Nathan Deal as Superior Court judge. Additionally, he served as city attorney of Elberton for 28 years, as judge of the Elberton Municipal Court for 10 years and judge of the Elbert County Magistrate Court for three years.

He was sworn in as Superior Court judge on March 4, 2015, and was elected to a full four-year term on May 24, 2016.

Phelps, who achieved the designation of Eagle Scout himself in 1966, has served as Scoutmaster of the Elberton Troop 127 of Boy Scouts of America since 1978, producing 48 Eagle Scouts during that time. He is also a past president of the Elbert County Chamber of Commerce, the Elberton Rotary Club and Elbert County Little League.

Phelps and his wife, Pamelia Jo Gaines Phelps, have two children and four grandchildren and are active members of Elberton First United Methodist Church. He is a 1973 graduate of the University of West Georgia and earned his law degree in 1976 from the University of Georgia School of Law.

Among numerous awards for professional and community service, Phelps is a recipient of the Award of Merit from the Northeast Georgia Council of Boy Scouts of America (1990), the Silver Beaver Award from the National Council of Boy Scouts of America (1993), the Georgia Super Lawyers designation (2005) and the Elbert County Chamber of Commerce Leadership Award (2011).

“The legal community in our state owes a debt of gratitude to Judge Phelps for his many years of exemplary service,” said State Bar President Robert J. “Bob” Kauffman in making the presentation, “not only for his many years of exemplary service in the practice of law and as a jurist but also as a public servant in his hometown of Elberton and the Northern Judicial Circuit, and as an outstanding leader of the State Bar of Georgia.”

The Distinguished Service Award is the highest accolade bestowed on an individual member of the State Bar of Georgia. Recipients in recent years include several former chief justices of the Supreme Court of Georgia and the current president-elect of the American Bar Association. The honor recognizes “conspicuous service to the cause of jurisprudence and to the advancement of the legal profession in the state of Georgia.”

The Northern Judicial Circuit Felony Drug Court will hold a graduation ceremony on Monday, June 20, at 3 p.m. at the Rock Gym, 45 Forest Avenue, Elberton, GA 30635.

This is the second graduation ceremony since beginning in Elbert County in 2012. Four men and women are expected to be among the graduates. The ceremony marks their completion of an intensive program of comprehensive substance abuse treatment, close supervision and full accountability.

The Northern Judicial Circuit Drug Court is a judicially supervised court docket that reduces correctional costs, enhances community safety and improves public welfare. In these programs, seriously addicted individuals remain in treatment for long periods of time while under close supervision. Court participants must meet obligations to themselves, their families and society. To ensure accountability, they are regularly and randomly tested for substance abuse, required to appear frequently in court for Superior Court Judge Chris Phelps to review their progress, rewarded for meeting goals, and sanctioned for not meeting clearly stated obligations.

Research continues to show that treatment courts are more effective than incarceration, better than probation and better than treatment alone. Treatment courts are this nation's most effective strategy to reduce recidivism among substance-addicted, nonviolent offenders with criminal histories. Nationally, 75 percent of individuals who complete such programs are not re-arrested. Instead of punishment, these programs provide life-saving treatment to those who need it most.

I married my high school sweetheart, whose late father was an Elbert County Sheriff and Georgia State Trooper.
