Loss of Legal Personality & Racialized Enslavability in Early American Law

Nineteenth-century jurist John Codman Hurd documented how early Anglo-American legal thought linked enslavability to race and origin, describing the “liability to become property” as historically confined to the Indian races of America and African Moors and Negroes.
