Around Thanksgiving in 2019, a winter storm brought almost 2 feet of snow to the Town. In the days following, the snow would melt, freeze, melt, freeze - to the point where it was like a luge trying to drive to my house. A member of the Board of Trustees at that time lived within my neighborhood, so I reached out to him - asking why our roads weren't plowed. Reviewing the Town's financials, I saw that we had the funds on hand to be able to do so, so was curious as to why I was having to drive on an ice rink to get home. The Trustee responded to my request, and after a handful of correspondences and conversations over the coming weeks, he asked me "have you ever considered running for the Board of Trustees?"

In April 2020, I ran for Board of Trustees, and then was appointed to the Town's Planning Commission shortly after. As a Planning Commissioner, I learned a lot about how the Town worked and identified specific issues which I wanted to affect change in. Specifically, the first item I tackled was to lobby the Board of Trustee Members and the other Planning Commissioners to allow the Planning Commission to start the process of updating the Comprehensive Plan which had last been fully updated in 2005-06. Shortly thereafter, the process began, and I was dually appointed to the Comprehensive Plan Amendment Steering Committee. As of a couple of months ago, this process culminated in the approval and passage of the Town's first real Comprehensive Plan in nearly 20 years.

In April 2022, I ran again for the Board of Trustees, and was fortunate enough to be elected to a 4 year term. While the time that I have served has not been without its challenges, it has truly been an absolute honor and privilege to serve as Trustee (now Town Council Member). Over the past 2-1/2 years, I took the responsibility bestowed upon me by the residents to heart: asking a litany of questions on almost every single topic - trying to ensure that each item that came before us was in the best interest of our residents, that each project was well thought out and every angle covered, as well to ensure that every dollar we spent was done so responsibly.

With the passage of the Town's Home Rule Charter in November of 2023, my term was cut short in order to move to Council Districts - which meant I would have to campaign again for a 3rd time in 4 years if I wanted to retain my seat. This past June, I decided that I would run again. For the next 4 months, I put countless hours and work into campaigning - not just for me, but for some of the other candidates as well.

I am absolutely thrilled for Andrew Moore for Mayor of Erie, Colorado, Brandon Bell - Erie Council Member, Brian O'Connor: Council Candidate, District 3, Town of Erie, CO, and John Mortellaro. While it is a bittersweet victory, there is so much that still needs to be done at Town Hall.

Although my campaign was not successful, without all of the support I received over the past 5 years, none of the items accomplished would have been possible. I would like to thank the thousands of individuals who supported me over the years - whether it be by voting, canvassing, poll watching, contributing, displaying a yard sign, attending an event for me, or through the words of appreciation and encouragement provided, or countless interactions that I have had with residents. I would also like to thank my Wife and Son, who allowed me to spend almost every weekend these past few months campaigning, and allowed me to spend my week nights sitting in or preparing for countless Town meetings.

While it appears as though my time working on behalf of the Town's residents may be coming to an end, I will continue to honor the commitment I made to the Town until the new Council is seated in January - by attending all of the Town or regional board and commission meetings I am appointed to, showing up to our last Council meeting next week and treating each agenda item before us just like I have for the past 5 years. And because I know that life happens, if a vacancy happens to occur with either of the current District 1 Council Members-elect and I am asked to fill their seat as the next runner-up (as outlined in our Home Rule Charter), I will happily honor the commitment I made to Erie and its residents by stepping up once again.

After a whirlwind of a week and constant waiting for new vote totals, we are getting closer to knowing how the final races in Erie will shake out. With approximately 9,000 ballots countywide still remaining to be counted in Boulder County (approximately 200 to 300 - or more - from Erie alone) plus any cured ballots - we unfortunately will not know the outcome of the last race in District 1 until Thursday when the final totals are released. To say it is close would be an understatement!

Today is the day! Regardless of how tonight goes, I can not begin to express my appreciation and gratitude for all of the countless individuals who supported my campaign and put in the hard work over the past 90 days. For those who volunteered to canvas, hosted a meet and greet, requested yard signs, contributed to the campaign - and those who have voted for me - I would like to express a heartfelt THANK YOU!!! An individual on the Town Council made a statement today, saying that with the opening of the new King Soopers and due to the Intergovernmental Agreement with Lafayette, "we will receive 100% of the Sales Tax revenue initially, until the Lafayette half of the NMC URA incentives are repaid."

For clarification purposes, this is a very misleading statement - saying that we will be "receiving 100% of the Sales Tax revenue initially".

A majority of the sales tax revenues are pledged to repay the developer's costs of the Nine Mile project, with a portion of Lafayette's revenues also pledged to repay the Town for certain Incentive Expenses.

Erie and Lafayette signed the global settlement Intergovernmental Agreement (IGA) in 2019, which outlined (among other items) that there would be a 50-50 sharing of all sales tax revenues and of the incentive expenses - but also noted that some of the revenues were "restricted" and had to be remitted back to each municipality, which could not be used towards repaying the "incentive expenses".

The Revenue Sharing IGA for Nine Mile was executed in 2022, outlining how the Revenue Sharing would be determined (https://erie.legistar.com/View.ashx?M=F&ID=10875674&GUID=297BC5DE-39F6-4C9C-9770-097A41993275)

Of the 3.5% municipal sales tax charged:

Restricted = 0.5% (goes straight to Erie, ~14% of tax revenue)

Unrestricted = 3.0% (~86% of tax revenue)
Erie's Portion: 1.5% (~43% of tax revenue)
Lafayette's Portion: 1.5% (~43% of tax revenue)

As noted in a Staff presentation in 2022, this Revenue Sharing Agreement stated that all unrestricted revenues from sales and use taxes - both Erie and Lafayette - must first go to pay the "Erie Incentive Payments" ($12.8 million), and for Lafayette must first go to the "Erie Incentive Expenses" (50% of the $3.2 million). Lafayette’s 50% share of "Erie Incentive Expenses" (approx. $1.6M) will be deducted from Lafayette’s revenue sharing until sharing obligation is fulfilled. This amount covers Lafayette's half for the land contributed, infrastructure extended, site development, etc. that the Town paid to activate the site - a repayment of costs, if you will.

Each municipality has pledged revenues up to a certain amount each year, in order to help pay the developer's bond obligations used to finance infrastructure improvements on the site (see slide 15 - https://erie.legistar.com/View.ashx?M=PA&ID=999258&GUID=9F730ADA-1185-432F-80C9-7DA1784C8992)

As well, Lafayette’s 50% share of "Erie Incentive Expenses" (approx. $1.6M) will be deducted from Lafayette’s revenue sharing until sharing obligation is fulfilled. This amount covers Lafayette's half for the land contributed, infrastructure extended, site development, etc. that the Town paid to activate the site - a repayment to Erie for expenses we made to help activate the property.

So, while it might be possible that the Town may have already met our annual pledge for the "Erie Incentive Payments" - and Lafayette may have a remaining amount of their $1.6 million share to repay us for our direct costs in the project - this is very temporary, as the Town will once again be retaining the revenues received on January 1st for remittance back to the developer.

Had a great time welcoming the new King Soopers to the Erie community this morning - even ran into a close friend that I haven’t seen in years!

It was easily one of the most attended ribbon cutting/grand opening events that Erie has ever seen (granted many customers were waiting to enter due to all of the giveaways and samples they were providing inside)

I am extremely disappointed by the comments made from individuals on the Council Majority related to the Town's financial forecast. To those individuals: please speak with Staff, ask more questions, and try to fully understand the scope of the situation - instead of just attempting to discredit an elected Council Member, who Town Administration has told directly after a conversation with the Town's Finance Team, does in fact "understand the budget and forecast very well".

Based on the comments that they have provided, it is very apparent that individuals on the Council Majority are not truly understanding of the Town's financial position, nor what the Town's Finance team is trying to make very apparent - the Town's forecast doesn't look good at all, items as basic as the Town's Street Maintenance are at risk, and the Finance team are having to develop contingency plans, if needed, due to the lack of funding available in future years.

I can only encourage them to speak further with the Town's Finance team to better understand the Town's current situation, just as I have. During the July Town Council study session, this past Thursday's Airport Economic Development Advisory Board (AEDAB) meeting, as well as during meetings that Staff has setup for me personally to discuss the matter further - Town Staff have presented a truly bleak and dire situation that the current and future Town Council must address immediately.

For instance, in this past Thursday's AEDAB meeting, the Town's Finance team presented and discussed information regarding the Airport Fund. The AEDAB members were concerned about the federal and state grant funding that the Airport typically receives, specifically related to the Town's matching funds for these grants. The AEDAB members wanted to ensure that funding would be available from the Town in order to be able to receive these grants, which are typically used towards Airport capital projects.

Town Council liaison Brandon Bell asked for clarification, if the Town Finance team needed more time to present information related to this with Council. The Town's Finance team said, "It will need to be a conversation while we're talking about the budget (with Council) because it's going to affect how much we transfer to (the) capital (fund). And so, ultimately this is looking like it would be about $1.6mil over the full forecast time, so that's $1.6 million we can't put towards (things) like street maintenance". Staff continued to say, "I agree, I would say that that's something we have to have during that conversation about the impact. And I really would want the entire Council fully understand what we would be doing there. I wouldn't want to rush it because it has a General Fund impact, and I want everyone on the Town Council to have a good understanding."

So again, for the current Council Majority - PLEASE - understand that this situation is real, and - PLEASE - understand the full severity of it. If Staff says that Street Maintenance is at risk, and says to an elected Council Member that we will have to figure out ways to make Street Maintenance whole to get them the funds they truly need, instead of the under $4 million currently allocated (which, per Streets, $5 million per year over the next 10 years is really needed): yeah, things are truly dire and serious, and should not be glossed over like the current Council Majority is.
