Happy Birthday to the BEST deputy in Stone County. IYA has been of great assistance to the Crane PD on several occasions. We sincerely appreciate her (and that guy with her too). It’s so nice to have such a great working relationship with the Stone County Sheriff’s Department.

After my Miranda Rights post the other day, I had a question about what exactly is a Terry Stop.

A “Terry Stop” originates from a 1968 U.S. Supreme Court case, “Terry vs. Ohio.” It allows a police officer to stop a person if they have “reasonable suspicion” a person is, has been, or is about to be involved in a crime. Reasonable suspicion is a lower threshold than “probable cause.” Probable cause is needed by the officer to facilitate an arrest, and basically means the officer more likely than not has cause the person committed a crime. Reasonable suspicion means the officer must be able to point to specific, observable facts (i.e. matching a suspect description or acting in a suspicious manner in a high crime area) and is not just a “hunch”. A Terry Stop must be temporary and last no longer than needed for the officer to confirm or dispel the officer’s suspicion. During a Terry Stop, the officer may search or “frisk” the subject for officer safety reasons and not necessarily for evidence gathering. A Terry Stop is generally used to investigate a crime and is usually less intrusive than an arrest due to probable cause.

EXAMPLE: Officers receive a report of a convenience store armed robbery (with a firearm) occurring 3 minutes ago. The description given is a white male, approximately 6’ tall, with black hair and wearing a blue t-shirt and blue jeans. You just happen to be walking out of the bank, just up the road from the store shortly after the call goes out. You happen to be a white male with black hair, 6’ 1”. You are wearing a blue t-shirt and blue jeans (but you are TOTALLY innocent). It is very likely the officer may preform a Terry Stop on you due to the description given. You may also be searched for officer safety due the report of the suspect possessing a firearm. As the stop continues, further details are given the suspect weighs approximately 300 pounds. You are obviously not 300 pounds and only weigh 140 pounds. At that time the officer would most likely release you do to reasonable suspicion being dispelled.

Remember the key points here are Reasonable Suspicion and Probable Cause. And in 1968 the Supreme Court ruled a legitimate Terry Stop does NOT violate an individual’s Constitutional rights.

On July 9th, Crane PD was honored to be allowed to host the monthly meeting for the Southwest Missouri Police Chiefs Association. Law enforcement leaders from Southwest Missouri met in Crane to discuss current legislation and issues affecting police departments and citizens in the area. Leaders include those from Crane, Springfield, Branson, Nixa, Ozark, Sparta, Reeds Spring, Buffalo, Boliver, Kimberling City, Fair Grove, Monett, Indian Point, Springfield Public School Police, Springfield Airport Police, Galena, Aurora, and Hollister. As well as representatives from the Federal Bureau of Investigation and Homeland Security. Also in attendance was Burt Whaley, Missouri House Representative from the 138th District. Representative Whaley updated the chiefs on current legislation in the State of Missouri.

I received a question yesterday from someone who was concerned their family member was not read their Miranda Rights when they were arrested on a warrant. I thought I’d take some time and attempt to clarify Miranda Rights. There are 2 conditions that must be met simultaneously, for Miranda to be required.

1. CUSTODY. Custody means a reasonable person in your position would not feel free to leave or terminate the encounter. It includes formal arrests, being handcuffed, placed in the back of a squad car, or locked in a holding cell. Brief, public investigatory detentions (like a routine traffic stop or a pedestrian "Terry stop") generally do not count as being in custody.

2. INTERROGATION. Interrogation involves questioning or actions by law enforcement that are specifically designed to elicit an incriminating response. In other words “guilt seeking questions”. If you are detained but not formally arrested, or if an officer is chatting with you casually without asking investigatory questions, Miranda Rights are not required.

Now an officer MAY read you your Miranda Rights at anytime, even though you’re not under arrest or being detained. This is usually done as a precaution in case the situation leads to an investigation. But Miranda is NOT required in this situation.

Remember, the act of being arrested does not always constitute a requirement of Miranda Rights. And simple, casual questions from the officer (ie: your name, birth date, address, how are you doing today?) are generally not guilt seeking questions. And if you are being arrested on a warrant already signed by a judge, no Miranda Rights are required.

I wanted to post this personal story to remind people how important it is to NOT drive impaired. Yesterday evening, my elderly mother in law was heading home from church when an individual, allegedly chose to drive under the influence, crossed the center line of the highway and struck my mom. She was life flighted to a Springfield hospital where LUCKILY she escaped with just severe bruising and a cracked rib. Also luckily she WAS wearing her seatbelt. The driver of the other vehicle was arrested by the Missouri State Highway Patrol for suspicion of DUI. This could have ended much worse. REMEMBER….YOUR CHOICE TO DRIVE IMPAIRED COULD AFFECT COUNTLESS LIVES!!! This holiday weekend choose the right choice. Don’t drink and drive, use THC and drive or don’t drive with any other mind altering substances!!! The choices YOU make now could affect you and others for the rest of their lives.
