An FYI for all of our Veterans that are getting ready to file or thinking about filing for an increase. The Department of Veterans Affairs has amended 38 CFR 4.10 to clarify how medication affects disability ratings. This amendment states that Veterans should be compensated for their actual level of functional impairment, and the effects of medication should not be discounted when evaluating their disability at the time of examination. This change is significant as it counters a line of court decisions that had previously allowed for higher ratings based on unmedicated conditions. The new rule is effective immediately and aims to ensure that disability evaluations reflect the actual impairment experienced by Veterans, not hypothetical assessments.

Does VA pay for cremation or burial expenses?
VA does not pay for cremation directly. Any item or service obtained from a funeral home will be at the families' expense. Some Veterans' families may be entitled to a burial allowance

Can I be buried in a National Cemetery if I’m cremated?
Yes, either in ground or above ground placement is available, depending on the cemetery.

Can my spouse be buried with me in a VA National Cemetery?
Yes. However spousal benefits do not apply if the Veteran is buried in a private cemetery.
