GREAT PROGRESS FOR MANUFACTURED & MODULAR HOUSING AT THE STATE HOUSE 🏛️
H.5113 unanimously passed out of the House Labor, Commerce & Industry (LCI) Banking and Insurance Subcommittee- a significant step toward protecting existing homeowners and expanding access to quality, attainable housing in South Carolina.
We appreciate Stephen Magyar of Oakwood Homes for providing strong testimony before the subcommittee on behalf of the industry. This is a perfect example of how grassroots participation from our members makes a real difference in advancing smart policy.
Here’s what H.5113 does:
- Protects replacement of existing homes (Manufactured Housing)
Prohibits local governments from blocking lawful nonconforming use when replacing a preexisting manufactured or mobile home with a new manufactured home ≤5 years old (explicitly including manufactured home communities/mobile home parks or any residential land). The bill ties the definition to 42 U.S.C. § 5402(6), ensuring alignment with federal standards.
- Supports on-frame modular homes
Amends Section 23-43-85 to explicitly apply placement standards to on-frame modular homes and establish certification requirements (roof pitch, eave projection, wall height, exterior materials).
- Removes an outdated restriction on modular display models
Lifts the five-year limit on display modular homes being used for residential purposes, adding flexibility for retailers and buyers while maintaining safety standards.
