10. ORD 2016-026
Ordinance Amending Title 2 of the Castle Rock Municipal Code by
the Addition of a New Chapter 2.35 Concerning Reimbursement of
Certain Recall Expenses (First Reading)

(This is in regards to Paul Donahue's request for about $15,000 in reimbursement for his legal fees for his protest hearing. Not 100% sure that is the reason nor the amount because the response to a CORA request was incomplete.)

The meeting starts at 6, but there is a 20 minute executive session at the beginning of the meeting wiht a bunch of other agenda items. Assume this agenda item will not occur until shortly after 7.

Cashing out of Castle Rock in a matter of months
Manipulates voter issues and meetings
Uses his platform as mayor for personal gain

It is too late to mail ballots, but you can drop off 24/7 (until Tuesday at 7pm, but why wait?). There are two locations in Castle Rock:
Town Hall at 100 Wilcox St
Douglas County Election Office at 125 Stephanie Place
If you did not receive a ballot, you may vote in person at the Stephanie Place location.

Castle Rock Town Charter Section 2-7. - Oath of Office.
Before assuming office, every Councilmember shall take and file with the Town Clerk or other designated person an oath or affirmation to support the Constitution of the United States, the Constitution of the State of Colorado, and the Charter and ordinances of the Town, and to faithfully perform the duties of the office.

Chapter 9.16 - Noise Control 9.16.010 - Legislative intent.
The Town Council finds:
A. Excessive sound and vibration are a serious hazard to the public health and welfare, safety and the quality of life;
B. A substantial body of science and technology exists by which excessive sound and vibration may be substantially abated;
C. The people have a right to and should be ensured an environment free from excessive sound and vibration that may jeopardize their health, welfare or safety or degrade the quality of life; and
D. It is the policy of the Town to prevent excessive sound and vibration which may jeopardize the health and welfare or safety of its citizens or degrade the quality of life.

Could this be interpreted that Paul Donahue and other council members are derelict in the oath of affirmation that they will support the ordinances of the Town?
