We the people indict Tonda Curry for all acts in violation of her duty to see that "justice is done."
While DAs prefer that citizens report crimes to the police first, they are not legally "gatekept" by law enforcement. If a DA learns of a crime through other means, they have full legal power and a duty to investigate and prosecute it on their own.
Article 2.01 (Duties of District Attorneys) states that the primary duty of the prosecutor is "not to convict, but to see that justice is done."
We the people further allege that Tonda Curry, against the peace and dignity, and in jeopardy of the public safety of the good citizens of the State of Texas, County of Van Zandt, has knowingly and intentionally failed to see that justice is done by and through the followings described acts, to-wit:
1. On numerous occasions engaging in plea bargaining so as to allow known sexually deviate child preditors to remain free and at-large, placing our youth at risk of abuse, assault, or worse;
2. Claiming insufficient evidence and refusing to bring to trial or otherwise prosecute a Raines County Judge for threatening litigants and engaging in other corrupt conduct;
3. Accepting large campaign contributions from a known criminal operator of dozens of illegal gambling establishments:
4. Giving a bogus legal opinion that such gambling establishments are "legal" and authorizing their operation, while knowing that such opinion rests on an unstable foundations not supported by the law or the majority of legal decisions rendered by courts of.competent jurisdiction across Texas:
5. Refusing to prosecute those responsible for those responsible for theft and fraud, resulting in the removal of a 90-year-old man, Udo Birnbaum, from his home of over 40 years.
6. Allowing City officials to close a church motivated by a desire to prevent same from engaging in their Biblically backed worship practices which involve aiding and helping "least of these" homeless (Matthew 25:35-42), and failure to prosecute city police officials, identified by a credible eyewitness, for intentionally and knowingly stealing, damaging, and destroying church property.
Enhancement paragraph: It is further alleged that prior to the commission of the above described offenses, Tonda Curry, in the State of Texas, County of Smith, was previously convicted of violating her public oath to ensure that justice is done, by intentionally and knowingly hiding and concealing from a criminal defendant known exculpatory evidence, resulting in fines and a termination of employment working as an assistant district attorney in Smith County, Texas.
