JURY NOTICE: PLEASE PAY ATTENTION TO YOUR JURY SUMMONS AND CALL THE NUMBER ON THE FORM TO CONFIRM YOUR SERVICE. Next week, the County Court at Law will be empaneling two (2) juries for VERY important matters - one on Monday, February 24th and one on Wednesday, February 26th. Both trials involve serious and time sensitive matters. Both will also require as many potential jurors as possible for those cases to go forward. Unfortunately, it has become necessary to add this extra form of notice for three key reasons:

1) SUMMONED JUROR RESPONSE TO JURY NOTICES HAS BEEN ABYSMAL. The Courts have been averaging a response rate of 1 potential juror for every 3-4 that are summoned. As such, 300 people may be summoned and, of late, only 75 actually appear. Recently, our sister court was unable to proceed with a felony sexual assault case involving a child victim because even less (approximately 60) potential jurors appeared. Cases of that nature need 80-90 citizens (at a minimum) for a fair jury to be assembled. Changes in law and the prevalence of jury scams in our community have made enforcement of jury notices extremely challenging so courts must largely rely on the people to voluntarily fulfill their duties in this role for justice to be done.

2) MULTIPLE COURTS SOMETIMES SUMMON JURORS FOR A PARTICULAR DAY AND IF ONE COURT NO LONGER REQUIRES A PANEL, PEOPLE MISTAKENLY BELIEVE ALL JURY SERVICE IS CANCELLED. Cases do settle, sickness of parties/witnesses/etc. intervene and any number of other factors may cause a court to not require a summoned panel; however, please pay particular attention to YOUR jury notice and call the number thereon to confirm that any jury panel cancellation applies to YOUR service. Court staff make concerted efforts to update the voicemail notification by close of business the Friday before your scheduled jury service so that people don't unnecessarily travel to the courthouse or make unnecessary arrangements for work/children.

3) YOUR INVOLVEMENT IS NEEDED AND NECESSARY FOR OUR SYSTEM OF JUSTICE TO FUNCTION. It is a quintessential, integral cornerstone of our way of life and our freedoms to have trial by jury. Additionally, it does not matter whether the trial case is criminal or civil in nature, virtually no case only affects just the named parties. In most, there are many, many people whose lives are or will be affected. To name a few - there are witnesses, victims who have been waiting for justice, lawyers, police officers, investigators, medical personnel, lab technicians, accused citizens who have been waiting to learn their fate or finally clear their names, and children seeking a stable home, as well as, countless family and friends who will be impacted by resolution of one single case. Often many, or all, of these folks have had their lives on hold while awaiting an outcome. In short, your service can positively touch the lives of many, many people both seen and unseen in the process. We all understand jury service is a sacrifice, an inconvenience, and an interruption to your daily life - but it is an act that is immediately beneficial to our nation, our state, and our community.

Thank you to all who willing serve when called upon and thank you for sharing this information.

This week we recognize the skill and hard work of our court reporter, Mrs. Becky Wheeler as courts across the country observe Court Reporter and Captioning Week. A court reporter’s ability to decipher, understand, and record all the things that happen in a courtroom is nothing short of magic. And while efforts are being made to move to electronic recording or AI technologies, we have seen first hand that none of those methods, as of yet, can come close to matching the accuracy and efficacy of these dedicated people. Mrs Becky is serving the citizens of Van Zandt County now for the second time in her laudable career and is a valued, beloved and integral part of the County Court at Law. Mrs Becky - thank you for your service, your friendship and all you do to make the Court experience so much better. Lawyers and litigants - thank your court reporter - and do them the favor of avoiding “east Texas words”, multi-syllable words or vowel-less medication names!

Only at the Van Zandt County courthouse can it flood during one of the driest parts of the year! Complaints aside, we are grateful to an overworked maintenance staff for going above and beyond to help us mitigate the damage, even when that involves late Fridays and early Saturday mornings. Thank you John Bowman, Erin Snyder, and Cris Burnett, as well as, Brian from CRT for your help on this and for all you do for Van Zandt County. FYI - The issue is related to the air conditioning system and may mean a warm few days next week until further steps can be taken.

Summer Update for your Van Zandt County Court at Law

As the summer heat pours down upon us and many folks are enjoying vacations and the last month of children being out of school, there's probably not much interest in what's going on here in the courthouse. Notwithstanding the same, at the beginning of our administration, a promise was made to regularly update this page with information concerning the goings-on of your County Court at Law and we are happy to again meet that obligation.

Probably, the biggest change in court operations to happen since the Spring update was the addition of the entire Van Zandt child protection (commonly referred to as "CPS") docket. These cases have, historically, been heard by a state-assigned associate judge and, other than for jury trial, heard at a location outside the courthouse. As of April, however, the decision was made that these cases - which often involve the most complicated of situations and always affect the lives and futures of so many - should best be heard by an elected judge who must directly answer to the citizens of the county and should be heard in the courthouse where there is the greatest level of protection from violence and disruption. These dockets began for us in May and are heard multiple times each month, with the most recent occurring yesterday (July 10). We are thankful to Judge Martin and our regional judge, Judge Charles, for their trust and confidence in assignment of these cases. The transition has been relatively smooth with further credit to the assistance of fine lawyers and staff. For us, this will make the 11th monthly docket that we hold -- adding to the general criminal, general civil, divorce/family, contested probate, contested guardianship, civil JP appeal, traffic ticket appeal, bond forfeiture, asset seizure and diligence dockets we already hear. This is also the fourth assignment order we have accepted to do our part to provide caseload relief to other courts.

The ability to accept these transfers has come in no small part from efforts made through our District Attorney's Office and the criminal defense bar to resolve a great number of felony and misdemeanor criminal cases. Because of this, cases in trial position (ready for jury/bench trial) has fallen to less than 5, including the assigned felony matters we have received by virtue of the April 25, 2023 Criminal Case Assignment and Docket Control Order or by recusal from other courts. The remaining dockets are running smoothly and the need for jury trials has waned somewhat as the year has progressed. All in all, things are in good shape.

We continue to be thankful for the ability to serve. Enjoy your summer, fall is coming!

*SCAM ALERT* PLEASE SHARE:

Our office has received multiple reports today indicating that a scammer is calling random Van Zandt County residents to tell them that they missed jury duty with our or another local Court and have a warrant out for their arrest. The caller is claiming to be a Deputy Sheriff (often "Deputy Steele" - who does not exist) who is seeking to set up "a zoom hearing with the Judge" to discuss what jail time will be ordered. Alternatively, of course, those called are given the option to pay a fine over the phone and avoid having to deal with a vengeful, upset judge.

THIS IS A SCAM. DO NOT GIVE ANY PERSONAL OR FINANCIAL INFORMATION AS A RESULT OF ANY RANDOM OR UNSOLICITED CALL.

Several things to know:

1) While response to jury summons has been dishearteningly low in recent years, the judges of Van Zandt County have NEVER sought out and fined nor jailed citizens for their failure to appear. We have only sought to educate and encourage citizens to appear so that cases can be resolved and parties can have their day in Court.

2) The Courts, as well as, the Sheriff's office / any other law enforcement agency, will NOT reach out to you or contact you by phone about potential jury service. There is an official summons that is mailed and specific phone numbers to call to receive automated information and instructions regarding specific appearance dates.

3) Do not assume that the number showing on your phone or caller ID is accurate. Technology exists to "spoof" numbers so they appear to be from legitimate services. Should you get a call, you can always hang up the phone and dial the courthouse directly at 903.567.7555 to confirm or the Sheriff's office at their non-emergency line - 903.567.4133. Should you receive this scam call, please consider reporting this criminal activity to law enforcement as well.

4) There is no procedure under our law that would allow a "negotiation" of a fine or fee on the phone, nonetheless, for any of the other activity that seems to be happening in these calls. Any attempt to collect money or personal information should be a large, bright "red flag" that the caller is not legitimate.

Sadly, these scams often target those in our community who are kind-hearted and trusting, as well as, those who may be vulnerable toward pressured and manipulative tactics. I strongly encourage you to share this with your friends, family, neighbors, church groups, and social groups in hopes that getting this information out quickly and effectively will prevent one more person from being victimized by this scam.

Thank you for your attention to this matter.
