USCIS officers found an H-1B petition in Florida that understated a job’s requirement, listing two years when the end client confirmed more than seven were required.

The discrepancy could have lowered the appropriate wage level by about $40,000. These findings led to the petition being withdrawn and revoked, protecting American workers from unfair wage competition.

USCIS officers uncovered H-1B petitions in Nebraska that listed workers as computer programmers, while site visits and interviews showed they were performing higher-paying engineering work.

This misclassification allowed the employer to pay lower wages and created unfair competition for U.S. workers. We coordinated with federal partners to put an end to it and protect American workers from unfair wage and hiring practices.

USCIS in Vermont identified H-1B petitions from a major IT consulting company that classified skilled technology jobs at wage levels below what the positions’ duties and requirements supported.

This practice undercuts required wages and creates unfair competition for U.S. workers. We denied and revoked multiple petitions, protecting American workers and preserving the integrity of employment-based immigration programs.
