The Drug Enforcement Administration (DEA) will open a separate Schedule III registration portal for state-licensed medical cannabis cultivators, manufacturers, testing labs and distributors in the “coming weeks.”

This registration process, through the DEA’s Diversion Control Division, opened for state-sanctioned medical cannabis dispensaries on April 29, following Acting Attorney General Todd Blanche’s signed order to “immediately” reclassify medical cannabis in the U.S., pursuant to the United Nations Single Convention on Narcotic Drugs, an international drug treaty.

The application for non-dispensary businesses to handle Schedule III medical cannabis will be available in the coming weeks.

The new White House drug control policy specifically called attention to the emergence of h**p products containing synthetic derivatives following the 2018 Farm Bill.

“Psychoactive derivatives of h**p are a growing concern,” the strategy states. “Although the h**p plant naturally contains small amounts of cannabinoids such as delta-8 THC, delta-10 THC, THC-O-acetate, THCP and other THC analogues, they are often produced in laboratories, and since the passage of the 2018 Farm Bill, products containing them have proliferated. Any final h**p-derived cannabinoid product containing these chemicals will be considered a Schedule I controlled substance under the h**p restriction regulations that are scheduled to take effect in November 2026.”

The White House’s national drug control strategy contends that delta-8 and delta-10 THC, THC-O, THCP and other analogues will be Schedule I chemicals.

Those banking on the 2026 Farm Bill to change the course of federal policy surrounding intoxicating h**p products must now take their concerns to the Senate.

The U.S. House voted, 224-200, on April 30 to pass the Farm, Food, and National Security Act of 2026 (the 2026 Farm Bill), legislation that regularly addresses the nation’s agriculture and food policies by, in part, funding programs used by farmers and rural communities. Congress is nearly eight years removed from when it passed the 2018 Farm Bill, which federally legalized commercial h**p cultivation.

The legislation would keep the impending ban in place while attempting to reduce regulatory burdens for industrial producers.

A federal judge has ruled that certain h**p-derived products can initially be used in Medicare pilot programs, pending resolution of a lawsuit by anti-ma*****na groups seeking to block the policy. The decision clears the way for the initiative, under the Centers for Medicare & Medicaid Services (CMS), to launch as the legal challenge moves forward.

The ruling denied an emergency request from the plaintiffs seeking to halt the program before it got rolling.
