By a 8-1-1 vote the excom on Sunday voted to make it so they only had to allow access to membership data if it was an action they MUST take...which they are now going to use to argue that Article 5 Section 5 of LPWI's Constitution is not an action they must take.
This is yet another escalation of matters as they are continuing to actively violate Article 5 Section 5 of our Constitution.
A. You can not invoke Art 5 Section 5 to permanently remove an officer(which a temporary suspension to term is)
B. Subject to Ratification clearly means that both the Constitution and Bylaw Committee vote AND the Special Convention vote must happen before a suspension can even begin. Their argument about money laundering and other illegal activities justifying their actions is not relevant as not only has Stephen not done anything illegal here but he was carrying out authority clearly granted to him by our Bylaws
Regional agreements are per the National Bylaws conducted during the 90 days prior to convention and up until Day 2 of the convention, so from the end of February until the end of Day 2 of a National Convention, even still Stephen didn't immediately use the authority granted to him by our Bylaws, which the excom does NOT have the authority to take away, he only acted when time was running out and he got wind that 6 states: New Mexico, Montana, Minnesota, Michigan, Illinois, and Iowa had left Region 6, regions were already forming and he didn't have time to wait until May 19th, which was our last scheduled excom before convention otherwise we were at risk of being regionless and having no representation.
As a result of using authority he had to keep LP Wisconsin from being regionless Michael Chianese responded by illegitimately pushing for Stephen's removal after he got his marching orders from former Region 6 Rep Mark Tuniewicz who had come to the realization that due to his poor leadership as a regional rep his entire region had fallen apart and he was going to lose his seat on the LNC Excom.
They failed to exercise any mechanism within the party they had as well as connections within the party to negotiate a new regional agreement, were informed during the end of a 3 month long window that the national bylaws clearly specify to do so, and then became upset when Stephen as chair of the party had taken action without them.
They then held an invalid meeting(LPWI requires a 3 week notice for meetings to be inorder) where they railroaded Stephen and claimed he acted outside of our Bylaws, as well as attempting to force him to condemn his own actions. As mentioned above they then illegitimately removed Stephen as chair by making the suspension permanent when our bylaws(see below) clearly specify that this can only be used to temporarily remove and have since choosen to sit on it as much as they possibly can rather than aid in getting the convention called, despite numerous clearly false claims that they aren't scared of a special convention. Which is a clear demonstration of their mens rea, they are well aware that this process is illegitimate so they've taken ever measure they possibly can in an attempt to solidify their coup of a duly elected chair by trying to prevent this from going before a special convention.
