City Council Proceedings
April 13, 2026
The regular meeting of the Mayor and City Council for the City of Battle Creek, Nebraska was held at the City of Battle Creek Council Chambers at 7:00 p.m. on March 9, 2026. Present for this meeting were Mayor Heath J. Mettler as well as Council members John C. Bomar, Tammi D. Barry and Eric E. Kraft. Council member John E. Hrabanek was absent from this meeting.
Mayor Mettler stated that a copy of the open meetings law was displayed on the south wall of the Council Chambers in compliance with the law and available for the public to see.
The Pledge of Allegiance was recited by all present.
Mayor Mettler officially opened the Public Hearing concerning an application from Jeff Meinke for a Conditional Use Permit to construct a garage over 1000 square feet on property described as Highlawn Addition Lats 6-9 Block 1, City of Battle Creek, Madison County Nebraska, at 7:01 p.m. The property is located at 304 West Park Street. The Public Hearing was closed at 7:05 p.m.
The Council voted to approve passage of RESOLUTION NO. 2026-003R: A RESOLUTION GRANTING A SPECIAL USE PERMIT FOR CERTAIN LAND LOCATED WITHIN THE ZONING JURISDICTION OF THE CITY OF BATTLE CREEK, NEBRASKA, UNDER AUTHORITY GRANTED BY SECITON 18-1306 OF THE REVISED STATURES OF THE STATE OF NEBRASKA.
The following Consent Agenda items were approved: Minutes from the March 9, 2026, Regular Meeting, the Treasurerβs Report from March, 2026, Building Permit Application for Mark Arduser, 108 West McAllister Street (Oversized Storage Garage) and Appointment of Rescue Personnel (Kaitlyn Pochop).
Mayor Mettler called for any comments or questions from the public. City Administrator Fleer introduced Katie Relitz, who had recently been hired to replace Tricia Wennekamp as the Deputy Clerk/Treasurer. No one else came forward with any questions, comments or concerns.
Departmental reports were heard and approved by the City Council.
The Council voted to authorize the residents at 107 East OβNeill Street (Tyler & Cassandra Bolling to remove the sidewalk adjacent to North Boyer Street from their property.
The Council heard an address from Mr. Russ Hamer, President of the Battle Creek Ball Association relating to the upcoming Baseball and Softball Seasons and voted to disburse the budgeted funds from the KENO Fund for assistance with said programs.
The Council voted to authorize the Fire and Rescue Department to place an order with Danko Emergency Equipment Company for a new ambulance.
The Council voted to direct City Administrator Fleer to establish a Sinking Fund for a replacement City Pumper for the Fire Department.
The Council voted to authorize the purchase of a Supervisory Control and Data Acquisition (SCADA) system for the Waste-Water Treatment Plant and Sewer System from Hydro Optimization and Automation (HOA) Solutions, Inc.
The Council voted to upgrade the SCADA System for the Water Distribution System.
The Council voted to approve passage of ORDINANCE NO. 2026-002: AN ORDINANCE OF THE CITY OF BATTLE CREEK, NEBRASKA TO AMEND SECTION 2-210 OF THE REVISED MUNICIPAL CODE OF THE CITY OF BATTLE CREEK TO PROVIDE FOR CITY COUNCIL APPROVAL OF ANY AND ALL PAY RATE ADJUSTMENTS FOR THE NURSING HOME ADMINISTRATOR AND DIRECTOR OF NERSING; TO REPEAL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT; AND TO PROVIDE FOR THE PUBILCATION OF THIS ORDINANCE IN PAMPHLET FORM on First Reading.
The Council voted to approve the Nursing Home Board recommended pay increase of three percent for the Director of Nursing for the Community Pride Care Center.
Claims On File were approved for payment.
The Council voted to enter Closed Session to protect the reputation of concerned individuals while discussing delinquent Utility Accounts. The Closed Session was entered into at 8:12 p.m.
The Council voted to come out of Closed Session at 8:28 p.m.
The Council voted to direct City Administrator Fleer to write off the balances of the delinquent accounts that had been listed in the agenda packets.
The City Council meeting was adjourned at 8:29 oβclock, p.m.
