Since 2019, breweries in the State of Maryland have been reporting the amount of beer produced each year. Beginning in fiscal year 2025, distilleries and wineries now report their total annual production amounts as well.

Along with these production numbers, manufacturers also report the amount of alcohol sold to consumers for on-premises and off-premises consumption.

2021: 12%
2024: 20% (current rate)

The ATCC's 2024 To***co Retail Modernization Act report maps to***co retailer density by square mile across all 24 jurisdictions. Baltimore City leads at 15.91 cigarette retailers per square mile, while rural counties like Garrett report just 0.07.

In fiscal year 2025, alcohol wholesalers delivered a total of:

14,795,459 gallons of distilled spirits,
11,776,354 gallons of wine, and
71,408,301 gallons of beer to retailers throughout the State of Maryland.

We are honored to share that the Maryland Alcohol, To***co, and Cannabis Commission (ATCC) received 1st Place in the 2026 National Association of Government Communicators - NAGC (NAGC) Blue Pencil & Gold Screen Awards in the Educational or Instructional Video category for our webinar and video series, The ATCC and the Maryland Three-Tier System.

Developed by Communications Officer Michael Nguyen the series was created to help make Maryland's alcoholic beverages industry easier to understand for the public, prospective entrepreneurs, and communities that may not always see themselves represented in the industry.

The four-part series explains how Maryland’s three-tier alcohol system works, clarifies ATCC’s role as a regulator and enforcement agency, and features real Maryland business owners through documentary-style profile videos filmed across the state.

The series includes:

Episode 1 – The ATCC and the Maryland Three-Tier System**
An overview of Maryland’s alcohol regulatory system and ATCC’s role within it.

Episode 2 – Crafting Success
Featuring Checkerspot Brewing Company, Clyopatra Winery & Vineyard , and Copper Compass Craft Distilling Co., highlighting Maryland’s manufacturing tier.

Episode 3 – Connecting the Dots**
Featuring Prestige-Ledroit Distributing Co., and Chesapeake Beverage, exploring the role of Maryland wholesalers and distributors.

Episode 4 – Retail Ready
Featuring Jasper's Restaurant and Off the Rox Wine & Beer, focusing on retail licensing, restaurant operations, and customer-facing businesses.

Produced entirely in-house in partnership with the Small Business Development Center Maryland Small Business Development Center, this project reflects ATCC’s continued commitment to transparency, education, and public engagement.

One judge noted:
“The comprehensive nature of this entry is impressive, especially when most of the work was done by one person. The stories are well told — video, audio, pacing, writing and overall editing.”

In December 2024, the ATCC began receiving multiple complaints from communities across Maryland about retailers failing to apply the correct sales tax on ESD products.

In response, ATCC Field Enforcement Division agents launched an investigation—conducting unannounced visits and purchasing ESD products to verify the tax being charged.

The findings were serious enough that the ATCC filed 19 criminal summonses against individuals for misrepresentation of sales tax or failure to remit tax as required by law. These early complaints and enforcement actions ultimately led to the statewide survey of 371 retailers, revealing widespread inaccuracies in ESD tax application.
