The August 8 special election for Issue 1 asks voters to “elevate the standards to qualify for an initiated constitutional amendment, and to pass a constitutional amendment.” It essentially proposes a similar basis to amend the Ohio Constitution that our Founding Fathers enacted for amending our American Constitution.
Issue 1 asks voters to do three things:
1. That future constitutional amendments be passed by 60% of the electorate, compared to the current 50% requirement.
2. That to qualify as an amendment, petitions be circulated in all 88 counties and signed by 5% of the electors of each county, based on the total vote in the county for governor in the last preceding election. Currently, only petitions from 44 counties are required.
3. Additional signatures may not be added to an initiative petition once it has been submitted to the Secretary of State. This will take effect January 1, 2024.
Issue 1 asks for 60% voter approval of the voters for passage of future amendments, not 50%. In fact, many public and private organizations require more than 50% approval of the membership to amend their bylaws or constitutions. The Ohio Democratic Party requires a 60% vote to amend its bylaws. Amending our constitution must meet a higher standard than the current requirements.
