The Broker-Lawyer Committee (BLC) continued its review of Texas real estate contract forms during its July meeting.

Topics discussed included:
💧 The new Seller's Disclosure About Groundwater and Surface Rights.
📝 Additional option fee language.
🏠 Property access, inspections, and final walkthroughs.

TREC is accepting applications for three advisory committees:

✅ Broker Responsibility Advisory Committee (BRAC)
✅ Education Standards Advisory Committee (ESAC)
✅ Texas Real Estate Inspector Committee (TREIC)

Committee members provide valuable input on issues affecting real estate brokerage, education, and inspections across Texas.

📅 Applications are due August 14, 2026.
📍Appointments will be made at the November 9, 2026, TREC Meeting, with service beginning January 1, 2027.

📣 Reminder for Texas real estate license holders: Updated TREC contract forms are now mandatory as of July 1.

The revisions include standardized terminology, a new definition of "Legal Holiday," updates to broker compensation language, an expanded Seller's Disclosure Notice, a new Water Disclosure, and more.

Your responses may be used in the forthcoming 2027-2028 Broker Responsibility Course, which as of January 1, 2026, is a required course for all brokers—regardless of if the broker sponsors sales agents.

📢 Contract Form Updates

Several TREC contract forms have been updated. Changes include a new Water Disclosure, updates to the Seller’s Disclosure Notice, revisions to contract language, and a new form related to back-up contracts.

Forms adopted for voluntary use (like the Seller’s Disclosure Notice, the Lead-Based Paint Addendum, and the new Seller’s Notice to Buyer of Removal of Contingency) may now be used. The remaining forms are also available for voluntary use until July 1, 2026, when their use becomes mandatory.
